What a thread!!

I just what feels like 3 hours reading it. Crazy stuff.

I read somewhere along page 6-8 I think about someone creating a thread to showcase a proper bill of sale. Did that ever happen?

I have a LOT of experience with these things unfortunentally. We have folks purchase cars "AS IS" and threaten to sue the first time something comes up. My response is and has always been: see you in court, I haven't lost one yet.

The reason we have never lost is verbage. CB was correct to say "AS IS" in his bill of sale. However, it is often a good idea to take it a step further. On ANY bill of sale for any item I draft, the verbage always reads:

"Buyer Beware: This (vehicle/boat/firearm/etc) is sold entirely AS IS and HOW IS. There are no warranties included, either EXPRESSED or IMPLIED. Nothing else is included, either EXPRESSED or IMPLIED."

To me, it sounded as though the first judge tried to claim that CB put an implied warranty on the boat engine by putting "emphasis" on the condition of the engine. Or she was just and idiot (I'm thinking possibly the latter). Either way, I think it is good advice to ALWAYS make a bill of sale, get several signatures (including a witness if you can), and keep it on file. It may save you money in the long run!

No I skimmed most, I did read every reply fromCB. This is good timing I just sold my sea nymph and the guy took it out 1 day and second day broke the pull rope. Other than that he really loves the boat. If anybody is over in Wilmington,NC and you see a old school 14' chocolate colored sea nymph, that is my old boat.

It's wise to get a bill of sale notarized upon execution also. And the early replies are correct, you can't include ENOUGH warranty language. These cases are won/lost based on the interpretation of the bill of sale--not the buyer's or seller's interpretation, but that of some third party. Therefore, it never hurts to "repeat repeatedly" ;) your intended meaning. Makes it much more difficult for the stupid to successfully claim ignorance.

My former mechanic sold an old I/B tri-hull to somebody in NJ about 15 years ago. It needed a new gas tank ( as he knew ). He was too impatient for his custom built one to be done so he rigged up a jerry can so he could take the boat out.

Seems somehow the back of the boat caught on fire while he was bouncing around on the waves. He killed the motor and jumped overboard ( he was wearing a PFD )

Well, the boat sunk and the coast guard required him to get the boat removed from the bay floor as it was an enviromental hazard.

On the same day he spent four digits to get his ruined boat raised, his custom tank was delivered. :D

I just bought my first boat last month. Read this today and was glued! What a thread! Longest one I ever read. Learned a lot about buying, running and when I come to sell my boat.

Good for CB, but a lot of time, money, stress, and heartache.

Good bump. I would have never seen it.

All I can say is "WOW"! I congratulate Country Bumpkin for sticking it out until the bitter end. The deal was: it is what it is. Maybe the kid was looking for a Clintonian definition of "is".

Great reading although after a while I just started reading only CB's posts to cut to the chase.

Somebody pm'ed me to ask if I am the Bondo found at iboats,..??
The guy who stretched out a hull by 5'...
I replied that, Ayuh, I am in fact Bondo from iboats, But,... No, I'm not Oops, the hull stretcher....;) :D
