I agree with you to an extent, but "as is", at the time was working. I have not made a mistake, but I'm not sure the marina did either. I have no idea if this happened before I picked it up or not. The one thing I do know is it never worked while in my possesion, and it did when I tested it and put a deposit on it for "as is". If it were a 50/50 deal, I would probably be ok with it. I have not mentioned the lawyer to the marina, I am simply getting in contact with one for advice. If he tell's me to suck it up and pay, I will. I just want to be sure I'm not getting screwed, and I feel as though I would be if I payed so much.

Have you tried checking a marine scrapyard? That's where I get legs every time I break one. I go through a lot of shallow water with my '75 merc 50 and I go through about 4 or 5 a year. The local marine recycler gives me new ones for $20 canadian.<br />Eric

Just because when it was previously tested on the water it ran fine, does not imply warranty that when the transaction actually occurs it will still work.<br /><br />I'd take their offer to waive labor fees as a strong gesture of goodwill in this instance.<br /><br />It would also be wise to shop around for replacement part costs to make sure their goodwill offer is in fact based on true parts & labor costs.<br /><br />Best of luck. That must be discouraging.<br /><br />Like you I also bought a boat with a malfunctioning motor. Assuming it was ok, but clearly I found out otherwise. Live 'n learn.<br /><br />Just my 2 cents.

Bf ,I didn't see where he tested the boat in his post.I just looked back an still didn't see it.<br />If he did test it an then it failed next time out thats a little different.Right?<br /><br />I hope things work out for him !In past I always test what I buy or at least put a deposit then test then buy.<br />good luck<br />Rich

It's right in the second paragraph He states that he test drove the boat... So I would also think that since he never left the Dock they would be a little more Generous.. JMO

Thanx for all the comments, I never expected so many! Here's a little update: <br /><br />After work on Friday I ran down to the Marina and asked to see the damage. I also examined the parts list and chatted with the tech, not the salesman. The one thing that really surprised me is that everyone seemed to genuinely feel bad this happened. After talking with everyone and examing the broken parts (and there were a lot of them!) I told them to order up the parts. I still plan on asking the lawyer some questions, however in the end I just want to get on the water. I do not feel like fighting a battle that I will probably lose. They gave me a copy of the parts needed and after looking up a few of the parts I found the prices to be in line with what I would pay online. Add on the free labor and perhaps this isn't a bad deal. It sux ... but I just want to get on the water, not wait a couple more weeks trying to get something for free.<br /><br />Even adding the extra ~$1000 to the final cost of the boat, I still think I got a good deal on it as a whole. <br /><br />This pic was taken a few weeks before I took it home, financing took a while. :) <br />

I guess the only other question would be whether anyone else "test drove" the boat after you did, and before you took posession. That could change the complexion of things significantly, IMHO.<br /><br />But, all in all, there is some value in having a newly rebuilt lower unit, so it is not just a cost to get back to "square one" in this case. You should have a more reliable motor overall as a result of this additional investment--new seals, etc--something to make you feel better about the cost!

yes, lower unit parts are pricey... that's usually a real eye opener for a new boater when something breaks. I remember chatting with a non-boat guy who had bent the prop on his dad's I/O, and then decided it wasn't too bad, so he took it for a 20 minute ride.. He came in when the outdrive was making "funny" noises. He wasn't too concerned, said, "ya, it'll probably cost me a couple hundred bucks to fix it." I smiled and said "ya, hopefully you'll get lucky" the next weekend I saw him he told me it was >$2500. He couldn't believe it.<br /><br />Anyway, good that you have a plan to get repairs going. It may sting now, but after some good hours on the water it'll seem like a smaller problem. Thanks for the update, and keep 'em coming!<br /><br />Eric... getting good lower units for $20 each?!!? I hope you're getting a few spares before someone wises up!!

No boat yet. The marina is still waiting on two parts to come in, I can't fault them at all for that. But it looks like another perfectly nice weekend without the boat. My freinds keep asking if I'll have the boat before the lakes are frozen... nice friends huh. :)

May I suggest you look at this differently?<br /><br />What if you had bought the boat and taken it out on the lake 5 times and it worked perfectly -- and then it blew up on the 6th time. I bet you would have not been happy - but accepted it better.<br /><br />I would look at the positive side of things -- by having it break on day one - they fixed it at a discount and you now have a bunch of new parts in it.<br /><br />(Try flying this explanation by the wife and tell me if it made any difference :) <br /><br />The question I would ask myself is - Do I think the seller intentionally cheated me. Sometimes bad luck is better than no luck at all.

Me thinks things could have been a lot worse.<br />In my opinion the expense is very acceptable.<br />And I absolutely agree with Motor Boater Bill<br />and John Ruff.

I don't believe they intentionally screwed me over, but I have a feeling they were not surprised something like this happened. I'm not upset anymore, I don't dwell on things. I'm just happy to have it back! It's not a bad thing to have an almost completely rebuilt lower unit. I just wish I didn't have to spend another grand!! :)
