The battery is only there to start the motor, the 'mag' ignition is a 'ground-to-kill' .
You could remove the battery and use a pull-rope to start the motor and run fine all day.
Either the ignition switch is defective or there is a poor connection somewhere between the ignition switch and the ignition switchbox on the motor. The black wire with the thin yellow stripe is the 'kill' wire, unplug this wire at the switchbox and test the end coming from the wire harness with an Ohm meter, you need to see continuity to ground (the motor block) with the ignition switch turned OFF, and no continuity with the switch turned ON.
DO NOT TEST the wire from the switchbox, any voltage applied here can/will damage the switchbox.
