abandoned boat in my FL yard

My ex husband in January 09' was given 30 days to get his personal assets off marital property that was reverted to me in divorce. He left a lot of junk and his sailboat. It has been 7 months and my son has a chance to trade it for a smaller sailboat he can handle on his own.

Do I have any legal right to sell the sailboat my ex abandoned on my property even though I don't have a title?

Apparently he doesn't have one either all he has is a title transfer form. He is willing to take my son to DMV to do the trade but then his name not my son's will go on new boat title. Can I stop that from happening?

Whay would you want to stop it, so what if it's in dad's name, your son probably can't wait to go sailing.

Agreed, let father and son have something bonding. It's good for your son.

Let's see, you are more interested in NOT having the boat in your Ex's name than in your son perhaps going sailing with him.....

Typical for a divorcee. You need to know that when you tear down your Ex the child is seriously damaged. He does not share the same relationship YOU had with the Ex. He needs to continue having a positive image of the Dad even if YOU don't. You are starting out your divorce by falling into the typical traps that uninformed parents fall into and this will come back and haunt you later. You need to do some reading up on what the professionals have to say about all this.

Try to work this boat thing out and show your son that you are interested in what will be positive for him rather than what you want. To be able to maintain a good relationship with his Dad is what is most important, not the stinking boat title.

You have not provided any indepth details about all this and better that you don't, but you have not included anything that gives the indication that you were interested in the son being able to do some boating with the Dad either. Only your concern about the boat being in the Ex's name. Best to you and your son in all this.

You don't have to do anything so special...

(I Won't comment on any of the divorce stuff, as thats not appropriate for this forum), but I will answer your primary question...

In FL there is a vehicle abandonment law... if a vehicle or vessel is left on your property for more than 30 days, you can apply for a new title in your name (as the property owner).

You simply have to go to the DMV, make the initial claim, then wait out the 30 days from the initial claim, at that point, they will issue a new title. They may require a LEO to come out and document the HIN of the vessel, and photograph the location where it is currently stored... you will need to provide proof that you are the property owner for where the item is stored. They will also attempt to contact the current registered owner at the last known address to give them notice that an abandonment title has been requested, and the original owner has the 30 day waiting period to remove the vehicle... if he/she doesn't get it in that timeframe, then its yours.

The only exception to this, would be is if there is a lien on the title... if so, You will need to satisfy the lien before a new title will be granted.

I have done this a few times myself... its not overly complicated, just have to do it the right way to get the title clear and free... doesnt matter how long its sat on your property already, you still have to wait the 30 days AFTER your initial report to the DMV to give the owner time to claim the vehicle.

the boat registration laws tend to be a little more relaxed fro sailboats if they don't ahve a motor.
