This post http://forums.iboats.com/showthread.php?t=525327&page=6 by Erikgreen along with some recent events in my area have me a bit concerned. One thing you should know about me is that I am 24 years old, and go to college 5 miles down the road, so i still live with the parents. Because of this I have limited knowledge of what goes into owning a house/residential property. My girlfriend of 5+ years lives in a relatively new development 20 minutes away in Warners, NY. Her Father told me years ago that no one is allowed to have a boat in the driveway/yard in the development(garage is ok if it is shut, and has no windows). So I get my first boat this Summer(1964 14' Starcraft). August we got back around 7pm after a long day on Skaneateles lake. We sit for dinner, and 45 minutes later we have a Trooper and multiple neighbors there to say that I'm not allowed to have those "pieces of crap" in the driveway. I had no idea that my orange 2007 Dodge Caliber, and my restored SC looked like crap. I told the Trooper my last name, and he knew my Mom(who works for County emergency system) so no tickets/fines for me or my gf's dad. Mind you this was still early in the night, around 8pm, and the rig was only in the driveway for 45mins-1 hour. To be honest I don't think the neighbors like me. They say my headlights are too bright, and wake them and the children at all hours of the night. I also used to have 15' sub woofers, and 1500 watt amp in my old car when we first started dating, and needless to say they did not enjoy me leaving at 2am. I DON'T DO THIS ANYMORE THOUGH!! I like to think I've grown out of that stage lol.:p

Well I have lived for 23 years at the same house. There used to be less than 100 houses within 2 miles. People would ride horses past our house to get to the woods that are now gone. Gone because the same developer as my gf's development has built houses there. Other developers have built over 2,000 houses nearby. I actually don't mind this too much, for some reason I guess I like more people around?.?. Anyways there has been rumor that there may be a movement to get a law or ordinance(what ever it'll be called) passed where the surrounding neighborhoods(including my road) wouldn't be able to have boats, snowmobiles, atvs, etc. in there yards. We have 2 boats(mine and Dad's). Mine fits in the garage, but Dad's is too big for it. Now I don't know if this will ever be law in our area, but I do know one thing; My Grandfather had built this house in the early 50's, we are one of the original families, and when I inherit this house there will be my Dad's Stamas yacht, my first boat, and any future vessel I may get(Islander lol).

The second paragraph is more of a rant i guess, but if anyone has an opinion to share especially on the first paragraph please feel free.

Re: Another thread got me thinking

Some people have little to complain about if you ask me. What happened to a mans home being his castle??? My boat lives in the drive with beat up van as tow vehicle. It's ugly as sin (van, not boat!). Thankfully no laws like that over here.

That si crazy and I woudl have a real porbelm with it, it si my yard that I paid for and I will put anyhting I want in it thank you.

Fishing buddies dad was looking at a house on a golf coarse with rules like that, no cars in the drive, you have a cetain amount of time to get your trash cans in and out, if you have flowers they have to be this color or that , and this was a big dollar house, no thanks.

I hope it works out for you and some people come to thier senses.

Unfortunately, I don't believe this will happen. In fact, it seems as though we (as a whole) are moving further away from common sense. For me personally, if something offends me, I either look the other way and try to ignore whatever it is. Seems people these days will scream at anything they "disapprove of". They'll essentially create such a ruckus that even though they may be the minority, the majority (especially those who hold no opinion on the subject) gives in to shut them up.

I'm glad I don't live in Syracuse. The county I live in has no codes reguarding what you can or cannot have in your yard/driveway. (Sometimes I wish they did but thats a whole other story.) There are some neighborhoods that have home owners assosiations but they don't have much teeth as far as enforcement goes. The wife and I have decide when the youngest gets out of high school we are going to find us a small farm out in the country. Five more years and we are out of here.

Good luck CPTom.

Re: Another thread got me thinking

This sort of thing is evolving everywhere that rural environments are turning into towns and 'burbs, CPTom.

People want their neighborhood to look like their home, and if they are numerous enough they will use laws and ordinances to force their neighbors to comply.

There are a lot of pluses to development, but they come at a price. . .reduced freedom to be different.

I have no silver bullet to prevent it; I can only predict that it will get worse. I would give up the family home and move if it got too bad.

Re: Another thread got me thinking

I know this has been discussed before here. I believe I commented then on a highly publicized case here involving a HOA telling a Korean/Vietnam war vet I believe, that he could not fly his American flag on his front porch, It was offending some of his neighbors and evedently prohibited by the HOA. He told them to go to hades and was threatened w real legal action. He eventually moved to another more rational neighborhood, but did not take his flag down, before he moved he got a bigger one, on a flagpole!!.... and folks would come by and wave their own flags up and down the street also in support of this fine man!! The publicity on TV and newspapers surely embarassed the HOA's pres. etc. as their names were also mentioned along w the name of the subdivision. My neighborhood is semi rural and from 1980 and has some sensible rules, No livestock,no commercial ventures etc. I posted in Ericgreens thread about my hording next door neighbors, they're yard is an eyesore, but it is "their" yard and I respect their right to do what they want w it. I guess i'm just not civilized like the easily offended folks who would tell others how they should present themselves and their property. I also believe the lowering property values excuse is just that, unless the whole neighborhood looks shabby.

Re: Another thread got me thinking

Laws vary from state to state, but in any "restricted subdivision" in Georgia, the restrictions (not law) are only valid for twenty years. The county may, at it's discresion, compel you to comply, with fines, but I don't know just how far they'd actually go to force compliance. I live on a 0.6 mile culdesac which is a small "restricted" subdivision... Only "stick built" homes. No manufactured homes nor mobile homes. Minimum of 2 acres to build a home. No outbuildings within 20' of a property line. These restrictions were set more than twenty years ago, but everyone is in compliance. The restrictions are to the benefit of those who live here, and only serve to increase the value of our property and homes.

I would hope that because you've lived where you do for so long, there would be "grandfather clauses" (no pun intended) declared to protect the rights of those who were already living there if rediculous restrictions like, "you have to have a garage with no windows if you want to garage a boat" were imposed.

I would seriously consider starting my letter to my Congressman for future use while hoping and praying for it to never be necessarry.

A New York State Trooper really told you to "Get those pieces of crap" out of the driveway?

I live in Georgia, but I'm from New york (Brooklyn). I have property in the Catskills. I hope and pray that neighbors, and neighboring communities never band together as "nazi's" to impose such "restrictions" or Lord forbid, get thier nazi ideals enacted into law.

I wish you all the best in dealing with this sad state of affairs in your neighboring community and hope this rediculousness does not reach your doorstep. Stay apprised of your local legislatures and be ready to start lobbying if you love your home like I think you do.

Re: Another thread got me thinking

In my particular "zone" of the city, there is a "required front yard of 35' from the lot line [at the curb] toward the house" within which "no vehicle may be parked." Which is kinda' stupid because (just like almost all house design in the last 20 years), my garage door is on the front of my house my driveway runs right through my "front yard." The language of the code basically allows for cars, and some light trucks to be parked there - trailers, boats, RV's, etc. are a "no, no."

Oddly, I had no clue that code existed and had my boat parked out there for close to 5 years. A neighbor moved in, didn't like my boat, didn't mention anything to me and called the city codes department. The city was cool about it ... gave me 30 days to move it, and I adjusted my garage to handle the boat.

What's odd in your situation is the immediate response of the "Gestapo" and townspeople (equipped with pitchforks and torches). - Kinda' like Veritas is talking about.

I won't tell you what to do, and I don't plan on moving anytime real soon ... but it will be the last house in a "sub" with restrictive covenants for us.

Drive around your gf's neighborhood at 2mph towing your boat, at night with your headlights on and stereo playing. Do this until they promise not to enact the new law. :D

I am surprised they got the trooper to show up so fast. He must have been related to one of the neighbors.

CP....ahhh the beauty of "planned" communities. I live in North Syracuse, not 20 minutes from you and my boat is parked next to the house for the winter. Mind you, it is on the trailer, covered with a custom made cover and currently has Christmas lights strung on it, but, nevertheless it is parked on the lawn between my house, the neighbors fence and house...and not a peep out of anyone.

Re: Another thread got me thinking

Who are these people and why are they so offended by the sight of a boat on private property? I would rather look at the most ugly, rotten, moldy, broke down hunk of junk boat or car every day (but I hav'nt seen one yet:D), than certain uppity, ugly neighbors!! Folks like this are offended by just about anything they don't enjoy or do themselves. But I'm sure they are PERFECT neighbors...............in their own minds anyway! Or I would rather live w good neighbors, w anything they want in their yards, than nosey, condecending, idiots w perfectly kept yards who think they must change the world to meet their own perfect veiw of it.

In PA the HOA covenants are not enforceable by law (police). The only way to get someone to abide by HOA covenants is to sue them. Municipal codes are a different story, but only slightly so.

I think in Texas the definition of Liberty covers more territory than in some other states, but the rule of the HOA still infringes.

I've got the perfect place for you. A palce where every man's home is his castle. It's even water front. You could keep your boat right out front :D

Re: Another thread got me thinking

It sounds to me like the neighbors have been just waiting to get you on something since all of the light and sub-woofer 'incidents'. As soon as you pulled up the street the eyes were upon you...waiting to see your next move. Doesn't it make you feel secure? :D

We have a city-wide ordinance here that all boats, RV's, trailers, etc. need to be behind a 6' fence or gate. It still amazes me how many I still see in the driveways though. I never complain mind you because it doesn't bother me, but just knowing that they know just as well as I do and still do it. Oh well I guess if they want to take the chance of someone complaining and have to deal with all that, then that's their business.

Re: Another thread got me thinking

The place where I have the summer place has a 2 week rule. Once put in drive you have 2 weeks in a year to have it there. Then there is a fine. Other house no problem on anything in drive, Most places have these rules for property values, which is bunk, more like so there is no keeping up with the Jones's.
