Hello I am selling my boat unfortunately because of being transferred to Kodiak and wondering if the title needs to be notarized when selling to private party?

Also, he is getting a loan for the boat so do I give him the title and he deals with it or do I have to send it to the bank where he gets the loan? Just not too sure how this all works. Thanks!!!

Every state is differant. If hes using the boat for loan, im sure they(bank) will want the title. Just make sure you are paid in full before,or at the bank during the transaction.

Notary requirements are determined by the state. Start by looking at your title and see if there is a notary block on it. Call the state agency that processes titles. Ignore advice on how other states do it.

For a small financed transaction, you send the title to the bank; the bank collects the money, and when it has both, it send you the money, processes the title with its lien on it, and keeps it. But don't ask us. Call the bank.

This can be accomplished several ways. Heres the basic rundown though. You have the title, he wants to buy your boat. When he delivers payment in full, you hand over the title. If he's borrowing money, he can arrange for his loan at the bank, when they have your check ready, you can walk into his bank, and exchange your title, for the check. I prefer this method, because you are recieving the money from a bank. No chance of a fradulent look alike money order/forged cashiers check etc.

As far as a notarized document, I've never heard of that, and I've bought and sold a lot of stuff. My experience is limited to only 4 states though. I don't think it's necessary.

Re: Boat title notary

thanks for all the input!! I would like to do it at the bank but he is coming from 3 hours away so I was thinking that once he hands me over the check Im going to call the bank where he got it from and make sure its a real check and the funds are there.

As far as wether it needs to be notarized or not, I will call someone tomorrow because it clearly says on the title that a notary is required. THanks

Re: Boat title notary

Just to add, even if the notary isn't required, it won't hurt to have it notarized. I bought a boat in PA, called NY dmv and asked about notary. They say no, not needed. A week later, went to re title it, they told me it had to be notarized. The seller was kind enough to drive 3 hours and meet me half way to get it notarized, but I wished I had just done it to begin with. It doesn't even cost anything to do.
