Boating and Beer in New York

Can anyone please suggest to me if this is a leagal combination?<br />I thought that for as long as at least one person doesn't drink on the boat it is ok to have open beer.<br /><br />Thank you

Up in NY I don't know, But in TX if the operator of a boat is at the legal intoxication level it is treated just like a DWI, as if he or she were operating a motor vehicle, which is aok with me.

:) Up here in Ontario (I think it's actually a Federal law so all through Canada) the operator is held to exactly the same laws, penalties and intoxication level threshold (0.08 mg ethanol / 100 mL of blood) as the driver of a car. <br /> :) As for the captain or any passenger drinking while under way, this is forbidden for recreational boaters with no exceptions; exceptions can apply for some commercial craft.<br /> :( In fact, for anyone to legally have a drink on a pleasure craft it has to be anchored, moored or tied up at dock and must also have a head, galley, and sleeping quarters (and real ones too, a pail, a coleman stove and a sleeping bag won't cut it!).

In New York waters, Open Containers are Perfectly Legal..........<br />But,<br />Drunken Boating is the Same as a Car.....<br /> DWI......<br /><br />So, Yes, You're Right.......<br />As long as the Sober person is Also the Operator........

when i got my boaters licence 2 years ago i was told that the law is not the same when it comes to boats and automobiles in Quebec. The operator of the boat can drink as long as hes not over the limit and hes guest can be as drunk as they want, unlike in a car were you cannot have any beer opened or closed or hard stuff in the cabin of an automobile.<br />SO PARTY ON ! WITH CAUTION !

A drunk driver is a drunk driver period.<br />Don't matter if it's a car, truck, motorcycle, or boat.<br /><br />And just as dangerous.<br />Why would anyone want to risk it?<br />Just don't make any sense to me.<br /><br />Please stay away from me and my family.<br />I have nothing for people that drink and drive anything.<br />Sorry, just my honest opinion.

SBN,<br />I'm with you on this one all the way. The only time I drink on the boat is when the boat is docked. I wanted to make sure my guests can drink while fishing on my boat.<br />Bondo, <br />Thank you for sharing your knowledge. I was not sure about it.<br /><br />Happy safe boating to all.

In OH anyone on the boat over 21 can drink including the operator granted he is not impaired. Same standard as DUI for BAC. I am not condoning drinking and operating a boat, just stating the facts.
