Up here in Ontario (I think it's actually a Federal law so all through Canada) the operator is held to exactly the same laws, penalties and intoxication level threshold (0.08 mg ethanol / 100 mL of blood) as the driver of a car. <br />

As for the captain or any passenger drinking while under way, this is forbidden for recreational boaters with no exceptions; exceptions can apply for some commercial craft.<br />

In fact, for anyone to legally have a drink on a pleasure craft it has to be anchored, moored or tied up at dock and must also have a head, galley, and sleeping quarters (and real ones too, a pail, a coleman stove and a sleeping bag won't cut it!).
