can I use my above deck fuel tank below deck?

I have a 12 gal above deck tank that doesn't fit under the benches and it gets annoying walking around it. I want to know if I can cut an access hatch in the deck and use it like a below deck tank. I could still take it out of the boat to fill it up and currently the vent in the gas cap just vents onto the deck where the fumes would settle in the bilge anyway. would I need to vent it over the side? I would really like to free up my deck space.

I would check the USCG boat builder regulation. I am really not positive.

I do know I had an older bass boat that had a storage compartment for the fuel tank.....

No it is not to be used in an enclosed space. As you mentioned it is the Vent, as well as the "Non" permanent Fuel Line Connection that are the safety hazard. Could probably work with hard hose connection and vent line to outside but you would have to check USCG Rules. You would have to change the cap with the vent in it. You would be much better off purchasing a poly fuel tank and installing somewhere legal and safe. It would be a final solution for your problem.
