Class Action Thoughts only

This is just the thoughts about class (CA) action law suites and not actual ones other then to use as points of interest. As a non-attorney and have an understanding that lawyers like CA's because if they do win, they get to get paid first before the pie gets divided up further.

So in a settlement and the award is 100 Mil, the lawyers get to come in and show their cost. There can be several law firms and have as many lawyers on the case with billable hours. Hours can be from 50 to 500 or more an hour. The latest Pharma case has 21 firms which made 450 depositions all going for their cut.

Then when it get divided out to the counties there can be much less, sometime even less then half

See post cards for one thing or another every now and then wanting to know if we wat to sign up for a CA

It seems like the lawyers always get the most of the money. My wifes brother died of cancer years ago due to asbestos related to the work he did. The amount of money payed out to everyone involved ( class action ) barely covered furneral cost...lets not talk medical cost...:mad-new:. Each case is different...however...lawyers get the first/biggest cut of the pie.

Something to think about...when joining a class action law suit you give up your right to sue individually.

Who makes out in the deal?

A defendant can forestall major liability by precluding a large number of people from litigating their claims separately, to recover reasonable compensation for the damages.

Lawyers get the largest chunk of the prize leaving the class action participants with coupons/vouchers for useless or unneeded services

The TV adds say there is limited time to join, and this is just a firm wanting more clients so they can submit more charges to the court and get more of the pie.

Be so nice to find folks actually think and not just walk around letting others (tv, social media, other) tell them what to think

The sad fact is that without these CA lawyers there would be very little action at all. They take cases on the come, hoping for a payoff. When one hits they can make a small fortune. They test the waters on many for no gain.

Ultimately the major share does get "absorbed" in billable hours and expenses. The end result is often is a hand slap for the defendant.

If they were not the first to get paid they would not get paid in many cases. The system helps them to get their share on purpose, they write the rule book.

The average lawyer salary in the United States was $120,910 in 2018, according to the Bureau of Labor Statistics most recent published data.


I've never joined a class action and hope to never have to.

My thoughts on lawyers are ....... Those that don't like lawyers don't have good one's.

Over the years I have paid out more than $50k to my lawyers, the benefit to me was saving more then $500K for business dealings.

For my daughter's accident we were able to negotiate a percentage down to 25% instead of the customary 33 - 50% for personal accident cases. Helps to know someone that knows someone. In the end he was happy as were we. AND yes he was paid first, the check was written to his firm. He paid us.

Layers are necessary and finding a good one that one can afford is even harder. I have friends that are lawyers, and one is a personnel injury. He even agrees in front of clients they appear to hate the other side, but after the settlement they are having drinks together
