How to obtain a mechanics lein

Does anyone know how to obtain a mechanics lein on a boat i fixed in Florida. Or where i can go to get some answers.

My dad was a mechanic for all of his working life. He obtained a mechanics lean (to the right) as a result of carrying a heavy tool tray around the shop :)

Seriously, it may depend a lot on the jurisdiction where the event occured. If you did the work in Florida, there are probably Florida laws that govern. Probably best luck if you look under "lien" :)

Done it several times in FL. The Courthouse. Then I get my money quickly!

Possession is 9 tenths of the law. If the boat is not in your possession, all you've got is small claims court. If you still have the boat, start by sending demand letters for the $ by certified mail with a deadline. Send a second letter 2 weeks later. Maybe he'll actually pay his debt.

You might want to check with your State for exact procedures. They're all different.

you can get a lien on the boat whether you have it in your possession or not, the work needs to be documented, contracts signed, any receipts for money he did pay, documentation of any letters sent (preferably via certified mail) trying to collect the debt. then just head to your county, or the county where work was performed if different than your own, and file a lien with the county clerk. This will not force someone to pay you, but does protect you if he attempts to sell the boat, you will still have to file a civil suit for collections (if debt is over $5000, or a small claims if it is under. Also be ready to settle for less than he owes if you go to court, its cheaper to settle if possible than to draw out a case.

Thanks for the help everyone!!! I got a hold of the courthouse in my county and have already started the process. They actually have a ready made kit with instructions.

First of all, are you an actual mechanic? Do you have a business, pay workers comp, have all neccessary insurance? (and in some states, a storefront/shop outside of your living quarters is also required)

If you are doing the work under the table (aka, you answered no to any of those), then you really don't stand much chance of a mechanics lien. In fact, it could turn around and bite you very quickly!

Thanks for the help everyone!!! I got a hold of the courthouse in my county and have already started the process. They actually have a ready made kit with instructions.

Last time I did it it took me 5 minutes. Took the owner less than 5 days to pay me.
