metal in lower unit

my son-inlaw just bought a 1999 90 hp yamaha, I checked his lower unit oil and there was a slight bit of water and small metal splints. Should he take it back to the dealer? Note that he paid 8900.00 for the rig (new 16' alum. wellcraft w/ trailer & troll motor)--Thanx for advice!

metal fuzz on the magnet is normal, water is NOT.
take back a used rig? depends on if the dealer sold it with any warrenty.
but in any case the water leak must be found and corrected reguardless of who has to pay.
