Survey/Pipeline problems

A pipeline is coming through my land. I give permission for the survey crews with stipulations that are in writing. One of my stipulations is that absolutely no brush, trees, grass, shrubs etc are to be cut. I have several trees that are cut down and lots of scrub brush in violation of the agreement. Another stipulation is that I be present when they enter and when they leave. I've had 4 crews on my land and none have complied. After I found the second crew while still on the land I contacted the main company. A man there assured me that from that point forward everything would be to our agreement. Well he has called before the last 2 crews entered but not before they left. If this is what I am to expect of my wishes why would I want to allow them to enter anymore? Anybody been there before? In the end what did you get per foot? Did they pay per tree destroyed also? What about creek crossings, what did they do to stop erosion?

You need a lawyer. Damage done outside of the original easement agreement should be recoverable.

I agree with ya JB. No pipeline yet. The actual survey crew, the ecological team, and two trips by the archelogiacl team have been through so far. I really don't care if they cut the little trees down or not, its just what we had in the agreement. I have some big trees that I will NOT allow to be cut or dozed. What bothers me (and why I put the no cutting clause in there) is they have already violated our agreement. I put it in there as a test, and they damn sure flunked it. I am documenting everything and taking pictures.

Does the pipeline company have an easement for a right of way for the pipeline to come through? If so they pretty much can do what needs to be done to the property, within the easement, for the pipeline to come through. That means if theres a 200 year old oak tree in the r-o-w they can and will cut it. They wont put a bend in the pipeline to go around the tree. If they have an easement for the r-o-w, did they have it before you owned the property or did they get it after you bought the property?

They don't have an easement, yet. All I have given permission for is the survey.

It is highly improbable they are going to do a survey for a pipeline without doing some damage to a few trees, brush or grass.<br /><br />Are there royalties involved if they choose to locate the pipeline thru your property?

I realize that they are gonna have to cut some of the trees PW. I told them not too to see if they would do it even though I said not to. They did. They flunked the test. <br /><br />Yes I will get paid if they run the pipeline. I don't have oil or gas minerals but I do have water and surface rights.
