When putting my carb back on. I noticed the clutch rod is no longer engaged. I cant fit my fingers down there to get it back in. Do i have to remove the oil pump to get it back on. And if so will i need a new gasket if i remove it. There is a gasket on the parts diagram.

I did not know a DT40 had a clutch much less a clutch rod.
Might try posting a picture of what you are speaking of

part #1 clicks into #23...... clutch rod into clutch rod arm.... its way at the bottom under the carb. and i cant fit my fingers down to pop the rod back in. unless i remove the oil pump which i know nothing about. im going to try it anyway, just not sure about replacing gaskets on the oil pump

Well that is strange, it looks like Suzuki does calls it a clutch rod.
To me a clutch is a spring loaded friction plate used to transfer power from motor to the transmission, and outboards do not have them.

anyway even if you can reach that without pulling the power head, it looks like there is a small tab sticking out of #23 to keep the rod from popping out of the hole.
So how did it come out?
If the tab is missing ,how will it not just pop right back out

the tab looks to still be there, i have no idea how it came out either. i m going to remove the oil pump today so i can get to it. will i compromise the oil pump gasket? or will there be a chance that its still good

Most likely someone tried to drop the lower unit without separating the shift rod at item (10), pulling down on the shift rod (1) rotates item (23) ccw allowing the shift rod to slide past the retaining tab and pop out. If you drop the lower unit about 1/2in, it should give you enough angle on (23) to slide the shift rod back in.
