Yamaha 25 HP 2 stroke ILLEGAL?

Hey all,

I am thinking about buying a new boat and I came across this packaged deal from alumacraft : http://alumacraft.com/deluxe-tiller-steering-boats/fisherman-160-new.php

It comes with a 25 HP yamaha, and I called a local dealer and he said he can't match that price and yamaha shouldn't actually be allowed to sell those older technology two stroked engines and that this is the last year they'e doing it (thats why the price lower). He then said like five states are banning the use of this type of engine because of the emissions and stuff. I am wondering if there is any truth to this? I found it pretty profound that they would be selling these motors if this is true.

Your next question should have been which five states have banned two stroke engines? When he told you, and had you been up to speed on technology you could have responded that two strokes technology is not banned anywhere but carbureted two strokes are indeed banned in some states and on some waters. Evinrude E-tecs are DFI two strokes and are cleaner or as clean as their EFI four stroke counterparts and are not banned. It is not illegal to sell anything in a state where it is legal to do so. Just yesterday I spoke with an Alumacraft (and other brand) dealer and during that conversation I was leaning against one of about five pontoons, all powered by two stroke Yamahas. If your state does not prohibit the use of carbureted two strokes they can legally be sold there and Yamaha will continue to supply them as long as the supply exists. Your only obligation is to ensure the areas you boat do not prohibit the use of these engines. While you may be able to use one in your state, neighboring state(s) may not.

Sales Tactics

When I bought my Alumacraft 15 44 tunnel with a 25 hp 4 stroke yamaha in 2001 or 2002 I went to the local triton dealer, told him I wanted a 25 hp 4 stroke yamaha, he said good luck because you just can't get them but he could sell me a two stroke. When I called my Alumacraft guy he and asked if he could get his hands on a 4 stroke he sounded confused and said he had 5 or 6 on hand and could get more...not hard to get.

I expect the first guy just wanted to move some old motors.

Illegal and not allowed are two different things.

I'm not aware of state wide bans on 2-stroke carbed engines. Possibly California?

There may be some specific waterways that do not allow them.

California does prohibit dealers from selling "new" motors that do not meet the current stringent emission requirements.

Beyond that, there are only a very few lakes and reservoirs in this state that do prohibit the use of older 2 stroke motors, and or motors that do not meet certain levels of reduced emissions.



I'll assume a lot of 2stroke motors have been replaced by some salesman's threats of banishment.

If Yamaha sells the motor you should be able to buy it and use it..

two strokes that meet california CARB emissions for the production year run are legal to sell.
yes some waters have banned some engines.
Yamaha quit importing most 2 strokes to the US market 01 jan 2010.
however motors in dealer inventory are still legal to sell.
