lease hasnt been renewed in almost a year, am I month to month?

no idea why, we'll be here 5 yrs in May, I just keep paying rent. We were always on the 12 month lease. Does this mean I can leave anytime? Curious....

There are leases and there are leases, EZ.

You need to read yours to see what happens after the initial 12 months is up.

read your lease, and check your state laws. but in Florida, if the lease is not renewed you automatically go month to month. which requires a one month notice before you can terminate. if you were only a month to month in the beginning, (no lease) you only have to give 1 weeks notice. remember this is in Florida.

...Remember that it works both ways. They could tell you to get out at any time too.

What TD said is true in most places. That said, you should check your original lease. It is not impossible that you could have a lease that automatically renews for another year, every time you make the first payment after the expiration of the previous term. Unless there is a specific law in your state prohibiting such a legal agreement, it would not be deemed unenforceable, and you would be on the hook for the new term.

House or apartment? Either way, I'd check to see if it has been foreclosed on. You might not find out until the sheriff comes with an eviction notice...

Very good point, and I missed it completely. If the pattern has been formal annual renewals, and now all of sudden there isn't a request for one, foreclosure might be an issue, as might a pending sale on the property. Make sure you have "Plan B" in ready to go, in case you need to move.

i will emphasize check the laws of your local area.

Foreclosure is a possibility, i know of a case that the man paid rent for 2 1/2 years, and the landlord never made a payment. when it finally went to auction the new owner, just leased it to the same tenant.

Here in Wisconsin after the lease is up you are on a month to month. As stated before check with the laws of your state. I would be concerned about foreclosure though as this seems to break a pattern with the landlord. California has one of the nations highest, and you could be out in the street in minutes if a sheriff shows up.

Its an apartment, I always renewed for another 12 mos. in the past. I'll have to find original lease(if I can) and check.

must have a new manager, getting lax. or assistant. most complexes stay on top of that.

I have rentals and the few that have signed leases have a clause in the lease to renew monthly with a 30 day notice of termination no formal lease is signed.

However, we live in the sticks where a man's word means something and most of my renters are not required to sign anything. I just tell them to treat it like it is their own place and in the end we are all happy because I end up doing little maintenance and they don't have to deal with rent increases.

no signed lease, state law takes effect over verbal agreement.

In some instances the price in for the place is lower if you have a lease. Once you go month to month the price goes up. what they do is you sign the lease with the high price but they give you a discount. Once the lease is over they dont give you the discount anymore. This forces the person to make another lease... Legal too...
