WOW !! It just snapped that winch post right off.
You might be able to salvage a few parts, but would it be worth it ?

I'm surprised no one got hurt, or run over by that projectile:eek:

Incredible.

Please post again once the situation has been resolved. I'm sure we'd all like to know how you came out.

Actually, the insurance company will possibly (likely) end up totalling this out. Essentially they become the owner and have the rights to any parts.
Since the claim process is under way, removing anything permanent from the boat would not be a good idea. I'm assuming it's now secured somewhere, anyway, and not in physical possession of the owner.

Oh yeah, NV plates on the offending vehicle. Where did that happen Doc? I travel out to Mead/Mohave all the time and don't recognize that section of freeway, was it heading back to CA on 15?

I dread that happening every time I tow. Hope everything works out for you.

Re: boat on freeway...

you WANT then to total that boat and trailer.

No way you want to wait 6 months for the repairs, or use it and hope they repaired it properly.

You have a good strong winch strap. :)

Been there, done that, only it was a crackhead in a stolen car. They will most likely total the boat and trailer and pay for the damage to the suburban. You could buy it back but why bother? You'd never see the boat the same way that you did before no matter how it would be repaired.

Re: boat on freeway...

Oh, I agree that I wouldn't really want THAT boat back. I don't think I'd ever feel confident in it again. I just think about how well I took care of it and how that doesn't even matter now. It's just a number on an adjuster's docket of things to do for the day, "old boat, trashed...give him $5.00"

the accident was about five miles south of Vegas on I-15. just after completing this lazy long right hand bend up hill. that is why I was only doing about 60 and I think he just entered the turn fine, fell asleep for a few seconds and didn't straighten coming out of the turn and just drifted into my lane...at ninety or so miles per hour. The hiccups probably woke him up in time to say "OH, SH*T!" right before hitting the back of me.

This is actually what I was trying to AVOID by leaving so early. People pulling all nighters and driving like maniacs back to LA! It's crazy how that freeway gets!!! I only needed to get to Barstow (150 miles) and then it was off through Mojave for me to get home (a nice relaxed drive, IMHO)

Man, that could have turned out worse in so many ways. Thanks for the follow-up on how it occurred, as I was wondering how fast he must have been going to knock your boat clear off the trailer while you were on the highway.

Nice bowstrap- I think you can salvage that part!;)

Re: boat on freeway...

The boat is still yours until you settle with the insurance company. I would make sure that you have it in a storage free facility or they will send you a mitigation letter that basically says they will not pay storage after a certain point. You can take anything off the boat, but it will reduce the ACV on it.
Salvage is usually the ACV minus what they think they can sale it for. You then get that amount and the boat. I would wait and hear what they say before threatening with a lawyer or getting one. Usually any more that the lawyer gets out of them goes back to the lawyer plus some. Just my thoughts on it.
I would find comparable boats in your area and if you negotiate start at that number. Make sure you have documents that show this value.

Re: boat on freeway...

you need to find comps and say i need a check to buy these boats. They are at this price range, i will settle for x amount. Don't do this until the third offer, and be firm. Make sure its the same engine, same length, and same accessories etc.

What are they going to do take you to court? We are not responsible for this man's boat, and outrageous claims.

Your turn..

Outrageous claim is my boat is on the shoulder of the road after there policy holder hit me. See pictures from Iphone.

Just be firm get a little nasty with them and you should make out okay. Just keep standing firm and stating hey, your client hit me I'm not losing a dime over your client being an idiot and hitting my SUV, destroying my trailor, and my boat.

I'm guessing the SUV will be an easy fix. But yeah, you need to stand firm and get reputable quotes.

I agree with everything just posted except the "get nasty" part. That is not necessary at all. Just be firm and very matter of fact about things. I just had a case last year where a FedEx truck backed into my Volvo. Mind you my Volvo is one of on 185 imported into the US. But to the insurance company it was a 95 Volvo 850 that was worth about $4,000.

They wanted to total it and give me $4,000 becuase there was over $5,000 worth of damage. I did not want a salvage title on my car so I asked them how much they would give me and not total the car. I don't remember the exact number, but I ended up taking $3,500 after turning down two offers. I was always as friendly as can be and let it be known that all I wanted was my car fixed which I did myself for less than $2,000. I found a guy parting one out in the exact same color and he delivered a bumper, a fender and both drivers side doors for $350.

Remember you are in a negotiation and their guy is totally at fault.

As many have already said, you have to be firm, and not backdown. They will show you book value (NADA, and we all know how NADA reflects actual pricing (LMAO)), and some 'similar' boats available in some radius from where you are. The insurance will say that any 19' bowrider is equivalent to your (insert your make/model here), when in actuality it isn't. Just be prepared to present them with lots of comparable ads. Start collecting the ads now, that way, when the time comes, you can send them a stack.

What kind of boat was yours? How long had you had it? And what did you pay for it when you bought it?

Anyway, it sucks to be in the position you're in, but hopefully it will all work out. Just be thankful that nobody was hurt or worse. That's really all that matters.

Re: boat on freeway...

Holy carp - glad you and your family are ok!

Maybe you mentioned it somewhere already, but how did the boat get recovered? Winched up on a flatbed?

Maybe it's international industry differences but here in Canada when my insurance co wrote off our sunk Sea Ray they had very little interest in the hull after deciding to mail me a check. Got back $7K on a boat we had owned for ten years and had cost "just" $10K to begin with. They just said, "The boat's yours too if you want. We certainly have no interest in it."

I had to pay marina storage for a couple of months but then got it back. It fetched a grand as a salvage project for someone else. Every bit helps!

Good luck and let us know how you make out.

^^^ I agree 100%

I'm not sure where you are going to be settling at, your home state or NV, but when I had my truck totaled about 5 years ago, I went through the insurance ringer. I found it tough to find comparable vehicles, mileage, features, engine, body, etc, etc, and this was a common Dakota 4dr. The ones I did find the insurance company complained about because they were not the same year, too far away, etc,,,,,, but their comps were far worse, wrong engine, 2dr not 4dr, excessive mileage, stripped interior... A friend advised me to ask them to have it independently appraised and I came out $1500 better. This was when the economy was good though.

Someone told me that they stopped offering appraisals (NV law ) for totaled vehicles, so I'm not sure that would work for you anymore, but it's worth a shot.

I never let the process get the best of me and always spoke with the adjuster in a calm manner. I can tell you one thing, they won't care one bit about how well you took care of the boat, so I wouldn't even go down that path. You have to present a case where you give them the information they need to get you a higher settlement. As Sergent Friday would say, "just the facts ma'am"

I woulds also be worried if this thin bent the hitch on the suburban how much damage that caused to the towing package.
