boat title

Hello. I bought a foreclosed house. In the drive way is a boat. I found the title in the glove box.How do I go about getting it put in my name? My states BMV said I can't without a lawyer and a lot of red tape.? Is this true? if so then I can't sell it. I can only scrap it.:grumpy:

Unless the titled owner is willing to sign it over not much chance of getting a title, unless the foreclosure documents included all remaining personal property. In that case you might have a chance. Either way you can most likely get more than than scrap value. Some people and some states don't care about a title.

Ask your closing attorney for a copy of the foreclosure documents sent to the previous owner. Some states state, even if not in the foreclosure docs, all personal property left becomes property of the buyer. If your state is one of those your closing attorney can provide a document the dmv will honor

You are luck that at least you know the name on the title.
Be certain you are looking at the most recent title and not an older one.

If they were the previous owners of the house;
I'll bet they would be happy to sign the title if you held up a $50 bill cash!

every state's laws are different. on the facts, though, this may be a good case to use the abandoned "vehicle" process. You may have to do it twice, two different processes, one for boat and one for trailer.

Look into abandoned property as well. You "might" be able to work a scenario of sending notices to the titled owner of the boat. With no response in a given amount of time, you might be able to take possession (through a process) of the boat as abandoned. That might be a 90 day process, but you'd be able to get rightful ownership too.

Hello and thanks for the replies. Oh well. It's a 1970 16' Ob mark twain. The interior is shot. So is the floor. I thought it would be nice to fix it up. It had a merc 65hp 650. I have that in the garage to keep. Thanks again.

You are going to spend more than what it would cost to buy a newer boat in decent condition... That is assuming the motor hasn't been abused and still runs. If that is shot, then you are going to be WAY over budget.
