Buying boat w/out title

Okay, I have another boat buying scenario. What if you buy a boat that has a bank lien? You give the guy say 10k and he gives you a bill of sale and the boat. What if he didn't take the money and pay off the remainder of the loan? You don't get the title released to you. The guy I bought my truck from gave me this scenario. I never really thought about it that way...

What state?

I'd never thought of a case like that, but.... In Georgia when you sell a boat you just do a notarized bill of sale and hand over the registration card to the buyer (no titles). I'm guessing if someone were that ethically challenged, in Georgia a situation like this would get real messy.

Washington State but I don't think that matters as I'm buying out of state. I bet this has happen before.

you do the transaction at the bank where the boat is financed, they have the title there. you pay off the loan, they stamp the title satisfied, and the seller signs it over to you. you give the seller the balance of the money. never give $ with out getting a clear title in hand.

What if the lien holder does not have a local branch in the area? Say a small credit union. What then?

contact them and see how they want to handle it. they may have a representative, agent, or attorney in your area. that they will have escrow the money. till title is transferred.

Exactly. Never buy a vehicle or vessel that requires a title without that clear title in hand.

And if the seller has an "open" title, it might be best to steer clear of that deal too. Could be a can of worms you don't want to open.

I had this kind of thing with a truck a few years back & did the transaction at the bank. Paid the balance of the loan to the bank & gave the guy the rest in cash right there & walked out with the paperwork.

Having been in the car business in a previous life I've dealt with all sorts of attempted scams and dead beats. When buying anything that requires a title or transfer of title, If you can not be handed a title or a title with a lien release, or make arrangements with the lender to conduct the transaction, you had better make the deal on the cheap because you will spend countless hours trying to get the issue resolved. Buying anything without a title may also leave you with stolen merchandise. While you end up eventually clearing yourself of any wrong doing, the time, money and effort clearing your name can be enormous. Play by the rules and everything works out fine. In my experience it is generally the very young adults who don't properly transfer titles or if they do, don't know how important those documents are and therefore create their own issues when they try and sell or trade this stuff.

last spring I sold my boat that had a lein on the title. I called the bank and they said it would take a couple of days after i paid off the loan for them to get me the title. I was freaking out, thinking it would kill the deal.

I talked to the buyer, and explained everything to him. I told him we would go to my local branch, he would pay them the money, they would pay off the loan, and place excess amount in my account.

The buyer shows up at my house, decides to buy the boat, I said lets go to the bank, he said no here is the cash get me the title when it comes in. I was astonished to say the least. He just wanted to put the boat in the water ASAP. He ran the boat for the weekend on my registration, not the smartest on either of our parts but it worked.

When he left I went to the bank paid off the boat, a week later I meet him and gave him the title.

We did not know each other before th transaction, but talking we did know serveral mutual friends.


I would still recomend completing the transaction at your local bank. Protects both parties.

I'll offer sort of a reverse view of why geting the paperwork done properly is important.

A couple of years ago, I gave a vehicle to someone I had known for quite some time. He was a person who had some problems in the past, but had been making clearly visible efforts to live a better life long enough, for most people to accept his change in behavior.

About six months ago, I started receiving certified letters in regard to the vehicle. Because Of the public nature of an internet forum, I'm not going to get into specifics, but suffice it to say that I was looking at significant financial problems, due to his actions. The problem was that I just signed the title over to him, and did not insist on doing so in front of a notary. I just trusted him to register the car in his name and obtain a new title, but he never did. He then moved to another state, and drove the car there with a plate that he took from another vehicle.

As it turns out, the DMV in my own state still showed the car as being registered to me. What I didn't know at the time, is that even when you turn a licence plate in properly, as I had done, they still maintain records as if the car continued to be registered in your name. This is done because people will often "put a car up," when there is mandatory insurance and they can't afford it, temporarily.

Contact with me as the "owner" was made, because the folks in the other state were able to track the vehicle via the VIN. When I emphatically stated that I no longer owned the car, and hadn't for some time, I was told that legally, I did still own it. Things became complicated because, even though I tracked down the person that I gave the vehicle to, he wouldn't help clear the matter up. I eventually did get the whole thing straigtened out, but it wasn't easy.

So, I guess the moral to my story is; do the paperwork properly and "no good deed goes unpunished."
