Can I fight the power company?

The power company has an easement in my front yard. They are going to put a gigantic transmission pole in the middle of the driveway. They are requesting a temporary work easement (8 months) outside of the original easement. They want to give me 3k for my troubles. I don?t want their money, I want them to put there pole somewhere else. Here are my concerns,
1 Transmission lines are loud and annoying
2 That gigantic pole will lower the property value
3 I want to have another baby but I hesitate to do so with 425K volts over my head.
4 I think that this line will cause interference with the baby monitor.

I can?t get a lawyer to talk to me without a 200-300 dollar fee.

I don?t want this pole on my lot. Is there anything I can do? I live in Florida

If the origanal easment paper work was writen up for the line thats there now(25 KVA??) and there is no wording of increase in KVA or extension or movement of structures, you probably do.

You may also try contacting your elected officials to see if they can help out. The road department in my county decided they wanted to put a yellow flashing light in front of my house. After I contacted my county supervisor, they were able to compromise a lot on the brightness of the light and adding louvres to reduce the light going into my house. I know its a little different but may be worth a try.

Do you have to fight them as this point? Did they ask you nicely or did they just plant it there through some sort of "eminent domain"?
What If you just tell them no? What happens then?

Your not me but if you were... If it were shoved upon me, with no recourse, i'd cut/chop/hack/saw/tnt demo the damm pole down, more than once if need be, untill they got the point.

Or... if you don't want to leave a trace... get a 2 foot drill bit and after the pole is up drill down next to it and stick your garden hose in there until the footing base is eroded away and the pole collapses... may take a week or 3, but it will go. then they will move it.

Just make sure you yank your hose out after it falls :)

May even get something nice out of the deal if you can get it to fall on your house.

If there is an existing easement over your property, then they can and will put their pole there, within the easement of course. And they will be able to service it too.

This easement would have been detailed on your land title when you purchased the land, and it would have been your choice to proceed with purchasing or not.
It will have no effect on the value of your property, as when you purchased the property the easement would have been taken in to account on the purchase price.

I have a sewer easement thru the back corner of a property....and they have the right to come on to my property and work on that sewer if the need too . Can't build any type of construction over it....only grass.

Get a gauss meter to check strength.
Pay the atty fee.
Get physicals on the whole family. Sue them for any subsequent maladys.
Move.

I have the REALLY BIG metal towers in my backyard and was stressed about it when buying the house 14 years ago because poles were evil at the time

So i got the meter and pointed and found my TV,Microwave,house pannel fluorescent lights(big level) ect have higher levels ;)
