from what I can tell South Carolina has no lemon laws for boats.

The Magnuson-Moss Warranty Act is federal, not state law and does apply to boats as well as cars. Do a little research on it and you just might see a light at the end of the tunnel.

There are a lot of details and fine print, but the biggies are:

...must give at the consumers request either a NEW replacement or complete refund AFTER allowing the manufacturer a reasonable number of attempts to repair the product. Multiple issues muddies the water a little bit, but three attempts to repair a single issue qualifies. They have already made two attempts on the floor and multiple trips for other issues(some more than once).

Thanks 180shabah, you've been a tremendous help! I've started reading up on that warranty act and so far it sounds very interesting and could end up helping me if this thing gets to that point. I plan on talking to the dealer on Monday saying this next repair (3rd one) is it and if they can't stop the cracks then it is time for a new boat or refund. To be honest though, I really have lost faith that they will fix this. I'll keep you posted on here and again, thank you!

I hope you have some luck this time. I wouldn't hold my breath. It sounds like there are structural issues under the deck. Ask for a new boat before you ask for your money back they are far more likely to do this then refund your money.

A member went through a similar situation on here a couple years ago with a new Tahoe. It was quite a pain but he did eventually get a new hull.

I took the boat in today to the dealer. They were willing to come to my house to get it but I wanted to point out the problems first hand and talk to them instead of having some workerbee come pick the boat up that knew nothing of the issues at hand. I have a list of things to be corrected again.

- deck cracks (3rd time)
- ski hook broke for a second time yesterday
- realized they never installed a fire port (all the other Mariah's have one)
- they dinged up the window frame when putting the screws in last time after fixing the window alignment problem (little dings from the drill every 6-8 inches)
- fix the black caulking that filled in a visible screw from when they put the window on
- redo the crappy caulk job around the dash covers

I also took pics of the window dash covers of another R19.9 and a R18.9 model on the lot because they look so nice and mine looks like crap. I told the dealer that is what I expect mine to look like again.
I also had a long talk with them about the cracks and they keep saying they will fix it and I have a warranty but I told them this was it for me. If this doesn't work I want one of three things, whole new deck, different boat or a refund. I'll keep everyone posted and thanks for the help and advice everyone has given me thus far.

You have really gone about this the right way, so many people go in swinging or screaming LAWYER right out of the gate.

You get so much more done when you are civil with people, no one is perfect, you have given them ample chance to fix your problems and what exactly you expect from them and what you want if they can't fix them so everyone knows exactly where they stand.

Well done.

I got my boat back today. One of the Sea Fox/Mariah owners actually brought it to my house. He told me when my boat came back for a third time he took it on as his own project and wanted to make sure it gets fixed right so we have no more problems with it. The repair work on the cracks looks great! He has ensured me it won't crack again because the previous work was just patches, they apparently re-glassed that section and used something called penske. All of it is beyond my understanding but it does look good and seems better than original condition. They also replaced my windshield and dash covers and all of that looks great again. The pop-out ski hook (which has broke twice on me) has been replaced with a flush one that I actually like better (he told me they have had issues with the pop-out one and have quit using it). I plan to run the boat all weekend and hopefully the cracks don't come back and nothing else pops up. I will say the 2 folks I have dealt with at Mariah have been great and really do seem that my satisfaction is a top priority to them. Hopefully it is and I have no more problems.

We had the boat out part of yesterday and all day today. No cracks! We put it through the test as we had people in and out of the boat, did lots of tubing, encountered some choppy water in Charleston Harbor (yesterday) and everything looks great! Oh, the new ski hook is a big improvement IMO. Anyway, thanks for the help and advice from everyone and hopefully you won't see me posting about any more problems. Take care everybody!

It cracked again! Crack #4, same spot and they said it wouldn't happen. Granted it took 3 weekends instead of one (I noticed it this weekend). I talked to Mariah/Sea Fox today and they want me to enjoy the boat the rest of this season and when I'm ready to store it for the winter they will take it and put a whole new deck on it and run it through their assembly line again treating it like it was a new boat. They are saying minus the hull and the motor just about everything will be replaced. They are putting this in writing for me and I should have something in the next day or two. This whole thing has been crazy and frustrating but I have to say so far Mariah/Sea Fox have been great.

good to hear you're getting something in writing. you wouldn't be the first person told to run the boat and it will get fixed over the winter only to find things like the dealer going out of business and nobody else honoring the deal.

if you haven't started taking lots of notes, do it. dates, names, phone numbers, pics....i hope you won't need it but it's best to have it all detailed.

a stress crack will always return if the stresses haven't been eliminated.

Sorry to hear you are having so many problems with your boat.
I will say that it sounds like Mariah has top notch customer service.
Please keep us posted. I?m really curious to find out how well the repairs will turn out.
