You never file a police report in CA unless someone is seriously injured. You do have to file a DMV accident report though if there is an injury or property damage over $750.

A police report only occurs if the police happen to show up which they never do for an accident as minor as this.

And just how do you know if his back/neck/shoulder pain is a serious injury or not?

A police report documents that the accident actually occurred, and the multiple versions of the truth, along with providing positive official identification of the people involved, and who was actually driving the vehicles.

If you call them, they ask if anyone is seriously injured. Apparently, they have better things to do. I would prefer them to be there to write up the report but that's the way things are here.

I've read all these comments and I truly hope it doesn't go to court for a huge lawsuit settlement. While a lot of people look at such events as their piece of the proverbially money pie and it is simply the insurances’ money so who cares, it turns out to be everybody’s money. I do believe in having your medical costs covered, but to sue for unbelievable huge amounts of money is surely not what this country needs...especially these days. It was a mere accident and I’m sure the guy that did hit you wasn’t meaning to do that. Now if he purposely runs into you, that would be a different story indeed. But get your medical bills covered as well as your vehicle repaired and let it go... Will cost us all a lot less in the future... Too many folks sueing folks these days and we all have to pay those endless increasing inssurance preminums for those suits!

I just want all costs covered and make sure my back etc isnt whacked up - I'm a bit more sore today which doc said would happen

Getting you bills paid is all you will be lucky to get..Insurance companies almost never pay for pain and suffering.The big settlements are only for those who are killed or crippled and disfigured for life. All others can forget about a payday...As a side note..Did you know that if you have a accident with an at fault drunk and you take him to court that even a minor misdemeanor you may have been convicted of as a 40 years ago CAN BE BROUGHT UP IN COURT....What would that have to do with the drunks liability? Nothing . but the dirty lawyers can still bring it up in court.
