I typically hate posts like this... but I had to do it anyways :D I've been a lurker the past 3 days or so because I had about 2.564 million things to do after my trip to New Orleans. I experienced enough stuff in that 1 week trip to create about 300 threads, but I'll sum them up here.<br /><br />First, I booked a 26' moving truck from Penske for the move. When I booked it, I was promised that the truck would be 3 years old or newer, cd player, and just a nice and decent truck. Well, I get there at about 10:30 (the time I told them I would be there) and all they have for me is a 6 year old 26' Box truck that USED to be a Sears truck or something. It was an International with a black cab and a white box. The guy assured me up and down, left and right that this truck would get me to New Orleans and back without issue. When I protested and asked if there was any way to get a newer truck like the ones they promised me when booking, I was told "Well yes, but you will have to wait until early this afternoon because we will have to transport one from a different location." Well, I needed to stay on schedule because I still had to load up the truck and drive to the southern tip of Illinois before the end of the day - thats where I had my hotel reserved.<br /><br />This forced me to take this truck. All-in-all the truck drove quite well. And I will admit, I did not have any mechanical problems per se, but I did have a MILLION other problems. Since this truck was a plain black and white truck with no indication it was a moving van, I had to stop and get out at every... single.. stinking weigh station from here to New Orleans. I got out, showed them my rental agreement and they sent me on my way.<br /><br />But that wasn't the worst... About 60 miles into Mississippi my brother was driving. We were about 5 miles from the exit we were going to stop and swap duties allowing me to finish out the trip driving to New Orleans. When all of a sudden my brother says "There's a cop pulling us over!" I'm like WTF is going on... This is the LAST place I want to be pulled over. Turns out, it was a Mississippi Department of Transportation officer... not a cop. He stated that he recently pulled over a truck that LOOKED JUST LIKE OURS and found 4 POT plants between the driver and passenger. He proceeded to search our pockets, wallet, socks, Truck cab, bags, glovebox, truck box, and suitcases for anything "illegal." <br /><br />Now, I knew I didn't have anything and I know my brother wouldn't have anything either. But we were driving a 6 year old piece of sh*t which has been driven by who knows what and has been who knows where. I was nervous as h*ll that he would find something that we had no idea was there. Which would in turn get us thrown into some backwater Mississippi jail. For the next 1.5 hours we stood on the side of the road as this yahoo dinked around. After not finding anything he wrote us a citation stating that we did not have our medical certificate and driving logs. Which is bullhonkey because Penske said I didn't have to keep any of that. We didn't get fined but the president of my company had to sign something and mail it to the MDOT.<br /><br />All in all I estimate that that screwing around added about 3 hours to our trip. So, here's the deal. After he told you "he recently pulled over a truck that LOOKED JUST LIKE OURS and found 4 POT plants between the driver and passenger," I would have expected him to add, "...and we rolled some of it up and smoked it, and I think I forgot to confiscate it."<br /><br />Sounds like a BS excuse for a shakedown to me. Welcome to the South!

EE- Couldnt you have refused the search of the vehicle? I'm pretty sure they ask you if they can search your vehicle and then you have the right to say "no".<br /><br /><br />I distinctly remember watching a show on Spike TV where a cop asked a guy he pulled over if he could search the car....the guy says "yeah go ahead".....turns out he has a few bags of grass in the trunk t which point the cop says something like "Why didnt you just say no to the search....I wouldve just had to write you a speeding ticket, now I have ya on drug charges"<br /><br />If I am wrong someone please correct me so I dont say something dumb next time I get pulled over. (had an incident once where I had a 3lb bag of sunflower seeds in the back of my truck which a cop thought was pot for a few minutes)

I dont believe police, when they have you pulled over, need a warrant or permission to search your car. I may be wrong but I think all they need with what they call "Probable Cause". If they ask "Mind if I look in your car?" and you say "yes" theres their probable cause.<br /><br />Deputy Dawg needs to pipe up on this one. I'm no lawman or lawyer.

If you had refused them to "rummage" through you vehicle they would have decided to arrest you on the log book issue. At that point your truck would of had to been towed off. At the impound the police would do an "inventory" of your vehicle.

That is not an arrest able offense. That warrants a citation.<br />They can upon your refusal to search call a dog in to go around your vehicle but in no way can they enter your vehicle unless the dog hits on something.<br />The officer could opt to get a search warrant from a judge but he has to have a real good reason to search. Not just a I think there is dope in there. That does not cut it in a court of law or with a warrants writer.<br /><br />Folks let me give you a small piece of advice.<br />If an officer ask you to search your car or truck just tell him or her no way. They can not detain you for a long period of time to satisfy their curiosity.<br />If I had been in that truck with ee and the officer had told me to empty my pockets I would have ask him if I was under arrest and if he said no the I would have in a calm manner told him no.<br /><br />We as LEO's have no right to search your person or property without PC and My suspicion's of you does not give that right.<br />I can ask and you can refuse and I can't do a thing about it after a reasonable amount of time.<br />A LEO can not keep you on the side of the road for a hour just trying to prove you have dope without good hard tangible evidence.<br /><br />I would have immediately ask for that officers commander when he started his conversation with the words I stopped a truck just like this one with pot plants in it.<br />That is toking into assumption that every body that has a truck going down the road is transporting dope.<br />That reeks of stupidity in my own opinion.
