Despite forum advice I responed to his emails. because he keeps calling and emailing. he calls from a restricted number, which I never answer.

heres the email I sent as a reply:

I don't know what to tell you, the boat came AS-IS with no warranty express or implied.
Also, my attorney has advised me to stop all contact.


from him:
Bull****!! You never stated that the boat was sold AS-IS otherwise I would'nt bought it. You lied about everyhting on the boat and engine, There is no way you took the boat to the river in the conditions the trailer, boat and engine are. Be a man and take your pieces of **** back, Attorney?? LMAO, You should look for better look for protection!! I already try to be nice and you make me look like stupid waiting for a week, Vegas my ***!! You had lied and also hang up the phone on me. Im not gonna eat $900 I promise you, one way or another you are going to pay.Now this is your last chance let me know what time you want me to drop the eggshell tomorrow. I drop the stuff, you give me my cash. No questions asked.

So I sent him:


attached is a pic of the hotel across from my hotel taken from my cell phone moments ago. Yes I am still out here. And you don't need to get threating over this.



If you feel it necessary file a claim in small claims court.

email him a copy of the bill of sale, and have nothing else to do with him. if i'm think right you sold this boat to a third party. tell him to consult the third party. that's who he got it from.

Why even bother with this fool,dont answer his calls...dont respond to e-mails...he sounds like a petulant child,in time he will get bored and go away,if not,keep copy's of ALL means of communication from him..enough rope and all that...and if that doesn't happen...sometimes this kind of fool needs an attitude adjustment:cool:

Copy everything you get from him, record voice mails etc.

Don't let some idiot bully you.

Is this really over a $900 boat, motor and trailer?

$900? For pete's sake. If I paid just $900 for a boat, motor, and trailer, I'd expect there to be problems with that boat. If there weren't any problems, I'd be absolutely overjoyed.

If this guy continues to threaten you, turn the messages and all paperwork over to the local police. There are some wierd, dangerous people out there.

That is a threat and I would take it seriously. I'd call your local police department and report it and supply them with the letters / emails. Maybe they will stop by and visit him.

Take threats seriously. Definitely file a formal written complaint with the police and take copies of the email to show them. Be sure to get a copy of the complaint and keep it in your possession (if you want to know why send me a pm and I'll explain). It's also illegal to do threats on the phone. Some states don't let you record without the person's permission first so be aware of that if wanting to give any voice recordings to authorities. If you have voice mail on the phone make sure the greeting says it is recording...that's the loophole. Stop communicating with the dude and don't tell him you are doing this stuff...let him hang himself and find it out when a detective makes a personal visit to him.

no kidding, I paid $750 for mine and even though I had to rewire the trailer and the motor wont idle right I havent even once got angry. So I need to put a couple of dollars and some time in to it?

Ill once again agree, save all correspondence from this guy. if and when it gets serious then contact the athorities. you will have all the documentation, all he will have is angry accusations.

yeah I'm not going tp let it bother me.

the guy across from me is a sheriff (for the city I live in) and the guy next door used to be his partner.

I told them about it, he said the PD might pile an Innocent report, but thats about all until he comes over

I thought all used equipment was buyer beware lol. Its the chance he took hes out $900 lol sounds like a loon he needs that heroin fix lol

Well, seems as tho someone isn't listening....Maybe now is the time to read the answers to this post and hopefully things will work out. Just a suggestion.

In many states, a sale between private parties is assumed to be as-is. It is always best to get that in writing though. If you have a signed "as-is" bill of sale it prevents the he-said/she-said arguments in court. The pictures you have of your boat are going to come in handy if he does take you to small claims court.

I am a former LEO. I am going to rewind myself back to that position and state of mind, to give you some advice as a LEO.

#1, don't respond or communicate directly anymore, in any way with this guy. If you must, use an attorney to do so. Again, DON'T TALK WITH HIM anymore.

#2, take all threats seriously. Regardless of how much you may think this guy is a punk or a childish brat, take all threats as serious ones.

#3, call your local police department, request an incident report and make sure you detail the threat concerning "you better get some protection" or whatever specifically he said. Depending on your local PD, you "may" even get them to pay the guy a little visit, just to "remind" him that should anything occur to you, your property or anything along those lines, that he will be a leading suspect due to the threats he made. They would likely also advise him if he has a problem with a transaction, to take it to court.

#3 alone could possibly diffuse the situation, if the guy is just a punk trying to scare you. If he is a criminally inclined individual, none of the things I have listed above will make any difference. In that case, expect to find your tires slashed, maybe windows broken..whatever he can do to you, to cost you the $900 and in his mind, make you pay that much out of your pocket.

Be vigilant and again, don't just blow this off. In his mind, this is serious enough to threaten you and you should keep that in mind.

I'm now fast forwarding back to present time, out of my former LE role.....:D
Dude, if he shows up, beat his cornhole with a rubber hose and a pillow full of grapefruit.
