Re: Martha is Guilty

The thing that bothers me is the fact that they could not hang her on the insider trading deal so they nailed her on the lieing thing, In my opinoin once they figured out they could not prove the insider trading they should have just let it drop. It just seems the proscuters had to try to save face. The whole thing just smacks of a witch hunt. After all I dont think there is one politician or for that matter a member of the supreme court jutice's that has not lied. Kinda of hyprocriticle if you ask me.

I guess what I am saying if there is not enough proof to hold her on the original charges why worry about if she lied about it. I just dont like the "we will nail ya no matter if we can prove it or not" mentality.

To me the whole thing is a farce!

Yep, had she done what she should have done, hire a good lawyer right away, and refused to talk to the Feds at all, she would have not committed the crime that she was charged of, and would never have been brought to trial.
Something is wrong with this picture.

Personally I didn't really know who she was other than she was a home improvement maven.

I don't know if what she did merits the coverage or personal attacks, I think there are better targets.

I have to feel that our sick public desire to see the icons fall is somewhat morbid. If she is guilty she should go to jail, but it should be tempered with understanding the same way we do with all others. I don't relish watching someone's total demise, regardless of how arrogant and irritating they might be. If that were the case then I have a whole slew of irritating jerks who should do some jail time.

Since she was found guilt, she should recieve the usual sentence, and be left alone. My guess is that she will rebound and be back in the public eye sometime soon as she appears to be a strong woman.

I do find the good old boy insider trading thing repulsive and I am aware that it is so prevalent that you could go after almost everyone over the rank of Vice President of any company. With all the mergers these days, lots of inside information.

Ms. Stewart was no novice when it came to the ins and out's of insider trading. She was a former stockbroker, and, more importantly, was on the Board of the New York Stock Exchange when the violations occurred. The lesson is that when the Feds come knocking on your door you had better tell the truth.

Jinx

I think there are a lot bigger fish to fry than Martha Stewart. Let's see what happens to the Enron management.

She is on heck of a businesswoman, from nothing to 800 million. Makes you wonder how smart she is though. If she would have only said to the feds, "I don't want to answer any questions without my lawyer present" or if she had just done a Clinton "I don't recall that", she would be still sitting high on the hog.

Re: Martha is Guilty

stock in her company has stopped trading
The exchanges stop a stock from trading when there is pending information that can materially affect a stocks price. They do that to prevent insider trading and ensure all people are trading with the same info. Once the info is out, the stock starts trading again.

gaugeguy - her arrogance got the best of her. She thumbed her nose at the Feds and got them mad and they nailed her hide to the wall. It reminds me of John Gotti's case. You can't afford to PO the Feds when you have dirty fingers.

I guess it says something about our legal system and society in general. Martha was found guilty and the courtroom erupted in applause and quite a few people are happy about it. OJ killed two people and crowds cheered when he was aquitted. Now crowds of people are standing behind Kobe Bryant, who raped a woman

The rogue CEO's and CFO's that are gonna be facing trial soon have got to be sweating bullets right about now ;)

What Martha did is pale by comparrison to what Kenneth Lay, Scott Sullivan and Bernie Ebbers did. I work for Ebbers old company. I personally believe all his and Sullivans assets, down to their last pair of underware, should be seized and they should be appointed public defenders. Sullivan is singing just to save his own a$$.

Re: Martha is Guilty

It's important to not fall into the trap of justifying bad behavior by pointing to worse behavior. Martha went down first because her case was an easy layup and she was so arrogant that she did not even think she had to put on a defense (That really POd the jury). Ebbers (WorldCom) has been indicted. Cozlowski (Tyco) is on trial. Fastow and Skilling have been indicted and Lay is on his way (Enron). It is not like the government ignored the other thieves and just prosecuted Martha.

One thing you have to remember is that by "Hanging this Big Fish", you are putting about 500 of her employees out of a job.

Locking up Tommy Chong for marketing bongs on the internet, and now Martha.

In post 9/11 America, where tax dollar expenditures for security are sky-rocketing every month, is this the best we can do? Maybe they deserve to be punished, but jail? We can't have it both ways. Let's appropriate our money wisely instead of pi$$ing it away on face-saving witch hunts. Chong is locked up because he stood up to the mighty Ashcroft. Now the taxpayers pay for his meals. It's a bit much, conceptually AND financially.

The law is the law. If you break the law and sell drug paraphernalia over the net (where, I might add it is nearly impossible to do age verification) you risk the consequences. If you start ignoring illegal activity you risk anarchy. You only have to look to SF to see the results. Chong is in jail becuase he broke the law and 12 citizens agreed.

Re: Martha is Guilty

I understand your point, Ralph, but I don't think jail time is an appropriate punishment for selling something on the internet that a kid can make after spending $5 at Home Depot. Punishments like this are more likely to cause anarchy than by your example. Abusing power has overthrown more governments than applying reasonable punishment to the crime.
