I had a look this afternoon and small claims is the route to go, I can file myself for only $75 worth the risk for such a small amount.

You only have to prove your case "by the preponderance of the evidence" in small court and not the greater burden of proof in civil court. Watch a few episodes of Judge Judy and you are ready to go. A few more episodes and I get my Law degree.

I think you are going to have a heck of a time convincing anyone that that boat is worth 6g's. More like 1500 around here, unless you have a $5000 stereo in it.
In that case, take out the stereo and sell the boat for whatever you can get, then go look for another boat.

I have talked to a lawyer and was told that it is not worth suing. That is why I started to consider parting out.


What that lawyer means is... Its not worth HIS time to deal with it because he can make more in less time on other stuff.

Lawyers don't like putting in a couple of hundred hours or more for 30% of a $4000 settlement.

A 1977 boat with a messed up motor is only worth around $500, at the most :(

This whole thing seems real fishy right from the start, but you can make money parting out boats, BUT if you already have $2,500 into it you'll never be able to part it out and re coup that....ive parted out a few boats

I am solley basing that off 2 of the same boat I saw listed within 50 miles of me this spring. I thought they listed it high but both seem to have sold so I guess that is the value?

They will just look at NADA which says average retail for that boat and motor on a trailer is $2325

Yes, I agree with Oldjeep and others, your actual damages may not be what you want. But, still sounds like it could be worth the experience.

How about some pix of the damage? We have no idea the extent of what your dealing with........ Maybe the estimates are way too high.....

I had a '79 Crestliner Crusader II. I would say the book price is about what it would be worth, unless it was in immaculate condition.....
