jmp-----if you really never got the copy of your insurance policy, that is a violation of state statute in most states and you should call your agent. He/She most likely has something called "errors and ommissions" coverage which may pay on this claim if he/she in fact never delivered this policy to you.<br /><br />Just something else to think about.<br /><br />I hope most of the people following this discussion realize that insurance companies now have 24-hour toll-free lines for reporting claims. When you hear a loud "bang" and you call for a tow, the next call should be your insurance carrier. They are much easier to deal with if the claim is reported immediately.

BD, I agree, and believe me, I called this in as soon as I knew there was a problem. The unfortunate part is that the marina was fooling around with winter storage. All this is spilt milk. <br /><br />In any case I filed with the Insurance commission last Friday, so the wheels are in motion.

db, All I ever got the coverage sheet listing the options and the cost of the insurance I purchased... for that matter, when I got my first letter from them grossing about the time it took to file the claim, the sited section D (I think) if the policy. I tore the house up looking for the policy and I could not find it. In the end, I did a web search and found a reference to that section from some other insurance company. <br /><br />I know when I renew my house/car insurance I get new policies. I will chase this down. <br /><br />joe.

Siezed Bearings, Shifter cable buckled,+ No Doubt, Some sort of Crack in the Cases...<br /><br />Your Mechanic's Theory doesn't hold water, because the Bearing Siezed First....<br />After the Bang, the Shaft was no longer Turning....<br /><br />The Cable,+ Clip are Results , Not the Cause ....<br /> <br />I Wish you the Best of Luck,<br />But, I Still think that your Ying got Yanged,+ You're going to be the one holding the bag....<br />Rodbolt, I think Might have your Only Way Out....

Joe, Forget the lawyers.<br /><br />You had water in the lower unit. Your fault-no doubt. Lack of maintenance.<br /><br />Don't waste the courts time and embarass yourself.<br /><br />Get it fixed and keep on top of it, from now on.<br /><br />Harsh words, but necessary.

Bondo. I could agree with your scenario. Lets assume the bearing froze and locked up the shaft, thus causing the damage to the lower unit. Replacing the bearing is not covered however the subsequent damage is. Insurance pays for the Casing and replacing the transmission and the shift cable. I pay for the Bearing and shaft. In either case a fair resolution to the claim. <br /><br />The freezing damage claim can be disproved. Their only claim is that because it does not show typical trauma, it must be freezing. For DJ’s benefit this is called “proving a negative”. Which will not fly.<br />joe

D.J. You must work for the insurance industry. You show the same ignorance that Claims adjuster shows. Again here are the facts:<br />- 40 Hours of run time on boat. <br />- Oil changed at the start of the season<br />- No rust on the gears<br />- No milky residue in gear case.<br />- Boat inside in a heated garage (three people who will sign an affidavit)<br />- No other boat has had any freezing damage. Boat (marina has 400 other boats)<br /><br />Incidentally all the replies have been constructive except for DJs. I entered my post for help and for the most part, with the exception of one ignorant person, everyone has been very helpful. And btw DJ you are the only one embarrassing your showing your immaturity. <br /><br />DJ, take a lesson from the other people in this tread, they asked questions, and provided helpful dialog. . I really don’t have time and patience to deal with simple-minded Imbeciles such as yourself.

Hey bondo, I was boating for 30 minutes. the incident happened at WOT... I can understand if they were rejecting the claim for other reasons., but freezing seems to far fetched. <br /><br />Also, the first week of Jan, I was at the marina, and the heater guy was there doing work on the heating system. So this place does have a heated shop. This is the work shop and not the storage shop. (I’ve never heard of indoor mechanics working in freezing weather inside.)<br /><br />In the end $4k is a drop in the buck for me, so it's not the point of money. The point that the Insurance company agreed to cover my boat, and when I put in a claim, the reject it without any proof or concrete evidence for the rejections. The gears were not rusty, the oil was not milky, the boat was kept inside,, the trauma looks line and explosion and not the typical freezing bulging. <br /><br />Thus far the insurance company has refused to record the statements of the service manager and the general manager. They will not pay for addition tear-down. I’m really left with no choice but to force the issue. When it come to court time, I will pay to have the lower unit dismantled and have the gears maga-fluxed. Right now I want to see if we can settle amicably. Again, I’m not asking then to cover the whole thing.<br /><br />Later

What are you missing here. DJ's premiss is that I did not maintain the boat, and that it was in bad shape. I really take offense to that remark. Low run hours and changing the oil at the begining of the season indicates that the boat is in good condition and that I do maintain it. <br /><br />Let me say it again, if they rejected the claim for the many reasons mentioned here that is acceptable with me, however the claim is rejected for freezing.... There's no proof that was ever water in the gearcase and that the bgoat was exposed to outside weather..<br /><br /> <br />You know what. Never mind, this is getting no where.. some people have been very helpful, but I really can't waist my time debating this...

Yep, I'm an insurance company employee that thrives on denying legitimate claims. <br />(You could not possibly be farther from the truth. But, hey, that doesn't seem to matter). <br /><br />I won't respond by throwing flames as our freind here seems to want to do.<br /><br />Bondo made the points precisely, some just do not want to listen.<br /><br />But hey, what do I know. I'm just an imbicile.
