(CBS 11 News) DALLAS A woman who wished to be identified only as Maria is eight months pregnant and living illegally in North Texas. She came across the border 12 years ago.

Maria says that she lives in fear. She is afraid of going to the grocery store, worried that someone will be there to deport her to Mexico. But she is also afraid of going hungry if she were to return. She has not seen her parents since she left her home. They have never even met her six-year-old son.

Now, there is a move in Austin to prohibit the children of illegal immigrants from becoming United States citizens. It's called House Bill 28, and it was drafted by State Respresentative Leo Berman (R) of Tyler. He believes that citizenship should not be automatic for the children of illegal immigrants, and he's hoping this argument will end up in a federal court.

"An illegal alien is someone who has an allegiance to another country," said Berman.

If the bill is passed, Berman believes that the children of illegal immigrants would also be prohibited from receiving state benefits like health care, disability and instruction in public schools. "These are the type of benefits that we're going to deny, and we're going to get sued for doing that, and that's exactly what we're looking for," Berman said. "We're looking for a lawsuit because, as a State Legislature, we can't change the Constitution. We can't call a Constitutional Convention. This is the only way we thought of that we can challenge the 14th Amendment."

Representative Berman says that, if the bill is passed, it will be challenged by organizations like LULAC and the ACLU.

Hispanic activists campaigning on behalf of illegal immigrants say that the bill has little chance of passing, and they do not believe that it will be signed by Governor Rick Perry.

Hooray!!!! I hope it has a "Grandfather clause" to exclude all "anchor babies", past and present.

How can the state of Texas determine US immigration policy? Isn't that what this guy is trying to do? That's not a state thing.

Somebody is finally "getting it".

12 years and no effort to become a citizen? Too bad, send her home.

If I hid out in Mexico for 12 years, my fate would probably be never known.

That’s a good start, now if we could get some teeth in a bill that addresses the reason they are coming over the border in the first place. Such as making the employment of illegals a serious offense, possibly make some people serve a little time in jail would slow the tide a bit.

I can't see a Problem with a State Legislature Doing the Exact Same Thing...............

Read the WHOLE article Willy, that's how you become well informed!

The whole point of the legislation is to bring it before The Supreme Court... you know, that body that determines Constitutional Law?... here in The United States?... With me so far?

If judges can overturn voted in state proposals and make it stick, I guess all is fair.

Illegal immigration is one of the few items that I vehemently disagree with GWB on.

Why fight a war on terror in the worlds back yard when your own back door is wide open? If anyone thinks only poor Hispanics are coming across, you are very mistaken. Although the media does not report it.

They mention federal court. That's not the Supreme Court. I mean who'd mow the Justices lawns and clean their pools?

Definitley true Willy, but as usual, we see another liberal deflection of the real issue. In stating the above we can only assume where your heart lies and that wouldn't take a long reach to do so.:/

LOS ANGELES -- Federal officials said Tuesday they arrested more than 750 illegal immigrants over the past week in the Los Angeles metropolitan area in what they described as one of the biggest such sweeps in U.S. history.

The weeklong series of raids in the five-county region targeted illegal immigrants who had previously been deported for crimes or had ignored final deportation orders.


The raids netted 338 illegal immigrants who were arrested at their homes and apartments and 423 who were identified in area jails since Jan. 17. Those already jailed will be transferred to federal custody when they finish serving their state sentences, said Virginia Kice, spokeswoman for U.S. Immigration and Customs Enforcement.

The sweep netted illegal immigrants from 14 countries in all, including Mexico, Honduras, Ukraine, India, Japan, Poland and Trinidad.

Lets see the subject is, or was …O yes, illegal immigration and Boomyal changed it to ..Hypocritical libs …OK.

How’s this for being a hypocrite, the President has a Republican controlled Senate, a Republican controlled Congress, he delivers five state of the union speeches and in four of those he mentions the need to do something abut the border situation and what do we get …nnaada. who needs a constitution?
I say amend the whole thing and give king George and his court jester life time control and go one with life.
just think of the savings for no more politics and the air time the TV could devote to real issues,like CSI or sienfeld.
the 14th amendment has been a bedrock cornerstone for a year or so.
careful what we wish for as we may get it.

I really, really hope that this works!! But I bet the ACLU will get involved to help protect the rights of the illegals. Sad but true.

I never said that I Like GW's stand on this subject,......
But,.....
Congress DID pass a bill last year,+ GW Signed that bill, that will build a 700 mile Security Fence........
Not really Enough, But a Start on SECURING the Southern Border......

'Course,...... The New Congress, that's Now being run by Your Buddies, the Liberals,....
Has Already started running thru a bill to Defund the Fence.......

I think this is a step in the right direction. I hope it goes all the way and passes. I'd like to see this problem attacked on all fronts though and maybe we will.

yes GW did sign the bill last summer but the republican congress last summer failed to provide funds.
dont blame it all on the current crop of idiots.
