How is building a casino "for the good of community?" I remember a time when gambling was considered BAD for the community.<br /><br />This is not an emminent domain issue, it is state sponsored theft under the guise of emminent domain.

I guess we have different principles JB. I was brought up beleive that when you take someone elses property, it is stealing, legal or not.

RF, The answer is: REVENUE! I agree, it a'int right......Eminent domain, in some cases, is a good thing....It can also be horribly abused.....(See my post above) I think these laws need to be looked at & tweaked to reflect todays world, not that of 50-100 years ago......JK

Personally, I think eminent domain is a legitimate concept. If you frame it as simply wrong because the property is going to become a Casino, then that is a different discussion. The Casino vs. a Public Park (for example) thing is about that, not eminent domain.<br /><br />Seems to me the eminent domain issue comes down to what the compensation for your property is. I would support something like 120% of an independent appraisal. Yes, I know that some people could not afford to rebuild or buy for 120%, but that is yet another debate.<br /><br />This is a big country, with lots of people. Some freedoms need to be compromised sometimes. May suck, but I see it as no different to supporting the President's obligation to use extraordinary methods to protect us. Some say they have lost freedoms, others say it is worth it . . .

I agree, quite a leap there....& illegal spying is a different subject.... A little spying, take your land, give up your guns....Where does it end?...JK

Still haven't heard the other side.<br /><br />All we get on the news is the "victim's" version of the other side.<br /><br />If Eminent Domain is used to confiscate property for a park, highway or airport is it still stealing? To steal is to take without legal basis and without compensation. <br /><br />The "poor me" card is often played in seeking excessive compensation, as well as presenting the intended purpose as immoral or improper.<br /><br />Excuse me guys, but I want the whole story before I start a protest demonstration.

My point was that eminent domain and what the property will be used for are two different debates.<br /><br />The spying connection was that our freedoms (owning property and privacy in these examples) are all open to compromise from time to time.

States don't have jurisdiction to tax transactions occuring on foreign soil, but in this case, it seems as though the tribe is going to own some off-reservation real estate. Now, in most cases foreign governments are tax-exempt entities...so...maybe there's tax revenue, maybe not. But one thing the state will get...tourism. Lord knows New York doesn't have enough tourism!

Maybe I am being to philosophical, but my thinking is,<br /><br />1) Concept of eminent domain? Yes/No<br />2) We elect people to decide what to do as far as community development etc.<br /><br />Sooo . . . if we allow eminent domain, and the community needs some property for the betterment of all (tourism, tax revenue, public recreation, redevelopment etc.) then the decision is about whether or not it is for the betterment of all . . . If we don't like/trust the people that decide if it is good for us all then that is yet another discussion or election . . .
