Anyone here ever need to use one?

I know the ones on TV are a bunch of scams..Few are really any kind of Attorney but just Accountants.
Talked to a couple of them and the fees are unreal. They want like 1000 bucks down and 300 to 400 a months payments while they drag out your case.
I looked for real local Tax Attorneys but not much luck.

Anyway,I got a letter from the IRS saying i owe 18k from the tax year of 1986! Why wait over 20 years to collect?
Back then i was young and driving trucks.I probably was only earning 18k a year at the very most.

I have attempted to speak with the IRS over the phone but can't get any help.
I sent them a letter to request a formal hearing.I have not heard back yet.

I want legal representation if i have the hearing.

Anyone here go through anything like this?
Any Advice would be appreciated...I wish we had some Attorneys as members.

Man all of this is a kick in the ba**s here with the economy and the Holidays coming up!

I would call your U.S. Senators and Congressman. A little checking on their part tends to free up things fast (been on both ends of that).

20 years, are you kidding??

Thanks Kurt. Yes,20 some years is unreal! I am sure 90% of that is interest and penalties..:rolleyes:

I have been expecting any day for them to seize my bank account.
A friend of mine went through this and they wiped him out.

I really did not want to air this on the forum but i really need advice.
I could scrape,scrounge and sell everything i own and pay it but that would suck!

Are you sure it was from the IRS and not a phishing scam??:mad::mad::mad:
Does it have your tax information for the year of 1986 other than to say YOU OWE US????:confused::confused:

Yes,They sent it certified mail from the IRS center in Memphis.
It had my SS number on the letter.
No actual tax info as far as what i earned that year but it is legit.

Thanks TD, I found plenty of accountants but none listed as Attorneys too.
I would like to use someone local instead of a large firm that operates Nation wide.
I found a place called Premier Tax Solutions who are rated A by the BBB but they are based in California.

Ayuh,....

Even the years are about the same.... I think my Issue occurred in 87...
I used my Accountant to sort it out... Right after most my accounts were Siezed....
Short story is,...
My Guy called the IRS,+ requested the pertinent Info on Why I owed the money, as I had been on somebody's Payroll that year,+ of course, taxes were taken out...
The IRS responded that they had No Idea why I owed, but they had paper that said I did....
Jay told them that if they couldn't tell Us why I owed, other than some piece of paper said I did, ei; No documentation to back it up....
We'll see ya in Court....

Since that day, Everything I've gotten from the US Government has never even mentioned any of this...
And of course,.. The monies Siezed were never returned, nor even acknowledged, other than crediting the account I didn't owe...

Bondo, So the money they took from your bank account was never returned?

Thats why i asked for a hearing.I want to be shown on paper exactly what they have.

I agree with getting your Senator and Rep to investigate, Gary.

I had a problem with the US Attorney in New Orleans dragging his heels in dispensing to me a judgement against a copyright infringement. I wrote to my Senator and had the check in 10 days along with a request to get her off their back.

I had another problem with a Texas bank about interest overcharges on a credit card. I wrote to my Governor (GWB) and in a few weeks the bank credited my account and apologised for the error.

The only problem with the IRS I ever had was when they read a 1099 wrong and thought I had been paid $760,000 for a seminar. They said I owed them another $225,000. I wrote them back and explained where on my 1040 I had paid tax on the $7600. I had actually been paid and pointed out the decimal point they had missed. They wrote back that all was okay.

It is entirely possible that a similar error created the huge bill they say you owe, but it seems to me that they have to produce documentation of their claim. Unless I am mistaken Elizabeth Dole is your Senator and I doubt that she would pass up a chance to nail IRS to the wall.

I will try to find where to write to her at. I wish i had my tax records from that far back but i don't.

Need to get someone on this before i stress to death over it..:(

I would contact the office directly. Snail mail is too slow. They often have a personal information form you have to fill out and fax so they can request information on your behalf. Most also have online web sites.

Gary, a certified CPA should be able to handle your issues ... my CPA was in IRS auditor, so he knows what to do when the IRS comes knocking (which they did once and went back the 7 years that I understood they were allowed to go back). You might have an agrument about 20 years ago! Statute of limitations ...

Call a CPA and ask them what experience they have with dealing directly with the IRS, explain your situation and see if they give you a knowledgeable answer. If not, I am sure my guy would be willing to look into it, or at least talk to you about it and give you some options.

Also agree about senator and/or congressman.

My wife is a tax accountant and I let her read your tale of woe. Here's her reaction:
  1. The IRS cannot assess you for 1986 taxes unless they find an item on a return within the past three years that they feel is fraudulent - and feel that a similar fraud took place in past years.
  2. Don't look for a CPA, you should look for an "Enrolled Agent" - they meet the same standard as a CPA with the IRS, but are generally less expensive.
  3. You can go to a tax service (she works for H&R Block, but I would guess others can help, too) and ask for an "Enrolled Agent" to assess you dilemma. They can charge you by the hour. They can also represent you in dealings with the IRS.

Gary,

Check this out Federal tax statute of limitations laws. It may be of help. Seems the IRS is Waaaaaaaaaaaay past their own Statute Limit on this one.

I feel a little better.Maybe with the right help i can beat this BS.

I will also call around about the enrolled agent CPA....good tip!
