Re: Titling old trailer in WV?

Yeah, as nice as all that sounds don't think any of it will fly. Big issue is it's a PA title and being PA requires the notarization, any state I take it to will require it also. The original owner (not who I bought it from) has washed his hands of it and don't want to deal with it. I spoke with the original owners mom and she told me her son is shady more or less and to mention a lawyer, but I don't want to go that route. He can very easily take the boat back and re-sell it again, being I didn't buy it from him but from someone who did. I might be able to place a storage lien on it, but again I think the police will have to impound it and hold it for 30 days then will auction it and I can try to buy it back, which won't happen unless I'm the only bidder. I'm sure there are several ways to get this done, just a matter of which route to go. I think just finding a blind notary will be my best bet.

you just need a notary, ask around, visit them, give them your story, some will say no, cant do that, some will say, I shouldn't, but I will do it this time, now next time you know better. worth a try, works sometimes.

You happen to know any coolbri? ;)

Their is also a thing called a mechanics lean that can be put against a thing but I do not know the details on that.

offer the original owner some money to get it right for ya.... No he CAN'T just take it back. He would have to report it stolen and that wouldn't fly... BTW the fellow you purchased it from CAN give you a bill of sale... all that is is a statement from him saying he sold it to you.... It may not be enough to title it but it IS evidence that you did not steal it.

ALSO understand that the original owner did nothing wrong and owes you nothing
The fellow you bought it from is the culprit... he bought it without PROPER documents and then "skipped title" and sold it to you without paying sales tax on it AND you are the second culprit because you ALSO bought it without proper documents......

I didn't say that to attack you but I think that owning the mistake will make you better prepared to negotiate with the original owner...Make it worth his while, don't threaten him in any way... Do the legwork for him so he has as little as possible to do.
IE I have this title and bill of sale for this boat, if you would meet me at xxxx address and sign them in front of a notary I'll pay you $xxx for your time... THANK YOU........

I did originaly contact the original owner but he won't even talk to me, that's why his mom said mention a lawyer. Yeah, I know I was stupid in the purchase. I didn't even think about the notary and didn't even notice until 2 days ago when someone said something on a car forum I was looking at.

The day I went to look at the boat started out nice, a friend and myself went up to look at it and spent a good 2 hours going over everything. We got their around 5 PM and by time we were done talking with the guy I bought it from and looking things over the temp dropped outside by 30 deg and the wind started whipping, so all 3 of us were now freezing and he grabbed the title and the hummingbirds and we exchanged. I seen the title was signed and we rolled to my truck to get out of the cold and headed home with it.

I'll be sure to call the guy I bought it from and see if he'll come with me to get a bill of sale notarized.
I'm pretty sure the boat is legit, I ran the HIN through a few websites for stolen reports and nothing came up. I might try boatfax too just to make sure, but generally having the keys and title are a good sign.

I know now to only buy from MD or VA for sure.

Oh yes, MH the mechanics lean works the same as a storage lien, it needs to be auctioned off.

If the mother will talk to you, I'd suggest asking her to relay an offer of some money to the guy... it's amazing how nice people can get when they realize they can make $100 in 2 minutes.

They no longer speak. It's a long story on that one, which makes me really question trying harder to get in touch with him.

Oh, I'd be more than happy to give the guy $100 to correct everything for me especially after dropping $2K on this deal, if I can trust there would be a good outcome.

Biggest issue is he no longer lives at the address listed on the title, I found the guy through Facebook but I don't think he uses it anymore. And there's no # to call him at. The guy I bought it from is trying to find a number for me though.

well you are in a pickle for sure.... There ARE states that will register a boat without much of anything for paperwork and once you have it registered in your name you can easily title register in your home state.... not exactly the right way but it does get the job done.

I had one at my old surveying office, she only notorized my signature, as the po of the bike I bought was a 6 hour drive, the dmv did not look to see if the po signed or anything they just see the seal and file the paper work, maybe in too much hurry to scrutinize:confused:
