A recent thread
http://forums.iboats.com/boat-topic...cs/larger-than-recommended-max-hp-641817.html

From the CG site and a link to their document.

MAXIMUM HORSEPOWER – The maximum horsepower
information listed on the capacity label is a guide for
selecting an engine for a boat. It’s not a violation of Federal
Regulation to install or use a larger engine. Boaters should
check state regulations for restrictions. They should also
take a look at their insurance policy regarding horsepower.

Correct, but the CG has the authority to terminate a "manifestly unsafe voyage", which can theoretically include overpowering, especially if the stern has dangerously little freeboard due to the weight of the kicker.

I have discussed this with the CG before because it is such a misunderstood subject. Yes they do have the authority to do something about a boat being operated in an unsafe manner, but we weren't talking about that, only HP.

My post kinda morphed lol. I was thinking about it though wouldn't both motors have to be running simultaneously for it to be considered overpowered. Seems to me it could only be considered as weight if its just on the boat.
