A coworker told me today that a guy in his bass club was claiming his tournament expenses on his taxes. To the tune of like 5 grand! Fees, lures, gas (boat and truck), licenses, line etc. We think he listed tournament fishing as his second job or something, as long as he keeps records and shows that he tried to make a profit... <br /><br />Dangit, why didn't I think of that? :( <br /><br />Being stupid stinks.<br /><br /><br />spots (duh)

Okay, here's the deal:<br /><br />Your fishing activity is either a business or a hobby.<br /><br />If it's a business, you deduct all expenses related to it; if the expenses are greater than your income (tourny prizes, guide fees), you can deduct the net loss. If income is greater, you pay income tax plus self-employment tax on the net profit.<br /><br />If it's a hobby, you can use expenses to offset the income; if the income is greater, you pay income tax but not self-employment tax on the net profit. If expenses are greater, you may not deduct the net loss.<br /><br />What you said about keeping records, etc. is absolutely correct. Bottom line, if you treat it like a business, approach it in a business-like manner, then a business it is. That's the law. If you never make a profit, never even finish in the money, the IRS will take the position that you have a hobby and disallow your losses if you get audited. You'll have to convince 'em otherwise.<br /><br />Say you fish a few tourneys for fun, and one year you hit the jackpot, win the boat. Get a 1099 saying you have $30,000 of income...then you pull out every single thing you spent on fishing that year...all the "practice", everything, not just tournament expenses, use it to reduce your tax for the year. Then, refile amended returns for the last two years showing net losses, get refunds for those years. And do the same for next year. A big profitable year in the middle of a few loss years is just normal business activity. That's how to work the system. It's why it pays sometimes to have a CPA do your taxes.

I was going to claim my expenses this year ($3500.00) but after adding up all my itemized deductions(expenses+morgage interest+etc.)it came out less then the standard deduction for married filing jointly. I kept a shoe box full of receipts for almost nothing.

gonefishie, business expenses (as opposed to job-related expenses) are reported on Schedule C and deducted on page 1 of 1040...doesn't matter whether you itemize. <br /><br />Just remember the "hobby vs. business" distinction...are you really operating a business? Look around & see what the other pro's are doing...trying to get sponsors? Fishing all the tournaments you can get to? Attending seminars? Giving seminars at bass clubs? Leave the kids at home? Is there a chance in Hades that you'll ever actually finish in the money?<br /><br />If it's a hobby, ya can't deduct the expenses unless you have some income from it.

He will get nailed in an actual audit, IMHO, If he dosnt actually have a business lisence in his state and a business name filed. His is a Hobby, and thats all there is to it.

Of course there's some audit risk involved, but it isn't a foregone conclusion. <br /><br />If a license is required for the business you're in, and you don't have it, it looks bad. If you claim to be a fishing guide & don't have a Guide's license. What kind of license do you need to be a Professional Bass Tournament Fisherman? A fishing license? Your business name = your own name. That's a normal kind of Schedule C operation, there's millions of 'em. IRS looks at substance over form. Even having all those things won't guarantee the they'll see it your way. If you don't walk the walk, don't talk the talk.<br /><br />Another thing: the tournaments you fish...if they're just of the Podunk Indiana Bass Club variety, where the combined purses of all the tournaments you fish wouldn't cover your costs (not just the cost of that tournament...all your fishing expenses for the year), or ya just compete for free gear, then you're obviously not anticipating a profit, therefore it's obviously a hobby.

They aren't Podunk, they're Federation and BFL tournies. I did finish in the money but wasn't enough to get a w-2. I think they give you one if it's over $500. If I'm correct you're not required to report earning less then $500 right?

All right!<br /><br />The payer only has to report over $500...to answer your specific question (this is how you will know I'm really an accountant): Yes and No.<br /><br />General rule, you're supposed to report all income you receive...but, since you have hobby expenses that more than offset your hobby income, you can ignore it.<br /><br />If you asked me whether I'd report a small amount that didn't come with a 1099, I'd politely decline to answer. ;)
