BRAND NEW Larson from dealer - Not NEW!

My wife and I bought a BRAND NEW 2004 Larson 210 LXi at a boat show this winter. The promised on-water delivery was deferred by dealer many times for over three months. Out of frustration, I picked up the boat two days ago with the hour meter reading "0" and found the keel scratched from beaching, the skeg had multiple deep scratches that have been painted over, long gel coat cracks on the hull, and to top all of this off, a disposable camera with pictures of my salesperson and his family enjoying our new boat while we were two hours away getting ready to make our third payment!! <br /><br />I plan on making the following phone calls on Monday: Our salesperson, my attorney, the state Attorney General's office, the local sheriff's office, Larson Boats, and may even contact the local media. This is all new to us but any advice or other help would be appreciated greatly!

Your attorney will be able to give you the legal advise but accept nothing but a new boat, brand spanking new. Contact Larson and explain whats happened , contact the local media, if youve got pictures of the salesperson on board with family Im sure they could make a good article which would get things moving faster than a rat up a drainpipe. <br /><br />Good Luck

Do all of the above, and file suit.<br />Insist on a new boat and compensation, plus attn fees, and file criminal complaint. Don't drop the criminal charges in return for a settlement.<br />Expose these lying bistards for what they are.<br /><br />Or, full refund plus compensation, as this deal will always leave a sour taste in your mouth.

Take them to the cleaners.<br />Lock stock & barrel.<br />Follow advice from Lawyer but if things dont move then use your equivelant of "whistle blower 9" which is in our area a media device for exposing people/companies evading taking responsibility.<br />Good luck & would love to hear the outcome of this one.

That's flat out wrong! Get your money back and go to another dealer.

If your boat is fuel injected have another shop take a reading on the clock that lives in the computor for the fuel injection. That will tell you how many hours are on the engine.<br /><br />Go get 'em.

Thanks for all the great advice. Sounds similar to my attorney's. The first letter has been drafted and faxed to the dealership and I'll be waiting for their response tomorrow morning. I'll keep everyone updated as things progress.

First of all, welcome to the forum, boy this is a farse, I would sue for the three months that you should have had the boat while the salesman and his brood enjoyed it and damaged it, absolutly not the way to do business, the first thing I would do seeing as how you have proof with the pictures is send a copy of the pictures (not the originals) to the manufacturer not the dealership, when all the smoke clears get you money back with damages and find another dealer. Let us know how you come out

However, I would not get all excited about a good settlement.<br /><br />The marine industry is lightyears behind the automobile industry in settling disputes. Also, judges/juries do no not look upon "new boat owners" as anyone that's been "injured". It's a jealousy thing, or whatever you want to call it.<br /><br />Check your local small claims court limits and take it there, if the amount is satisfactory.

You've got em by the short hairs.....<br /><br />Photos speak a thousand words.<br /><br />Let the attorney handle the case.<br /><br />The media is a good idea, the dealership will hate the attention.<br /><br />This sounds like the other thread that has been going on with Chaparrel (sp). <br /><br />I cant wait for the outcome....

Whatever you do don't get greedy. Try to settle this thing out of court and fast. You want a new boat and to be able to cover your attourney fees and maybe some money for aggravation. Get it and get on with life. You don't want this to linger for months on end. (...unless you think this kind of stuff is fun.)

Fun isn't the word I would use! I think "fun" would be a day on the lake in our new boat! I should add for all who are wondering...the damage to the boat only became evident after a good cleaning the day after bringing her home.<br /><br />As far as settlements go, I just want my NEW Larson. And to maybe have the dealer apologize for screwing the boat-buying public! As far as finding a new dealer, as I know I should, our choices as rather limited. We either don't get the boat we want, or drive for hours to the next (Larson)dealer. I have to admit that when the dust clears on this matter, I'll be very leary if I need this dealership for warranty/service work! Thanks again everyone!

Like i said before get in contact with Larson, most companys will deal with you on situations with a dealer like you have, they would rather give you satisfaction than get all the bad press over a shady dealer or salesman and will straighten the dealer out, if you go to the dealer they will claim you did the damage to cover thier butt, from what you have said the salesman can't wait for you to take your boat in for service so he and his family can take it to the lake again at your expense. (just my opinion)

if the computer shows that the boat was run beyond the 0 on the hour meter, there are criminal charges in store for someone. at least with cars, that's illegal or so i've heard.

How stupid can people be? Leaving a camera full of pictures showing there fraudulent and illegal acts. Unauthorized use of a motor vehicle, damage to said vehicle. Was the boat registered? To who? <br /> Me, I would demand a new boat at dealer cost (for lost time), a written apology from the owner and the employee to be fired. If I didnt get that, with a fist full of pictures, I would see them in court and it would be for a lot bigger numbers.

I am sorry to hear your boat buying experience has been tarnished by a selfish and quite careless individual (or individuals), but the advice I always give in this type of situation is to try to resolve it as quickly and professionaly as possible. Life is short and it in the big picture it isn't worth letting some shady person drag you down to their level. Let your lawyer earn his money and you keep your dignity in the matter. People like that usually get what they deserve sooner or later. He may find more time for boating while he's out of work! <br /><br />Please keep us up to date on this one!!

I went through that with a durango I bought.It was a demo,took them 3 days to long to "prep" it found out later the owners son took it for the weekend,after I found crusty pair of panties in the third row seat.things were big enough to fit a cow.All I got was an appolagy and interior steam-cleaned.I'd deal with Larson,they give a licence to the dealer to sell their boats.Good luck!!<br /><br /> Jim

Dealers can run boats on a Dealer tag just like cars except it is a temp one you put on the windshield when you get through peel it off and a little windex walla :eek:
