I have just had my worst experience on e-bay and was hoping to get some advice. Sorry if this goes on a bit!
I bid on and won a modem on ebay; I paid for the item immediately via paypal which was the sellers preferred method.
After two days my funds were unclaimed and I contacted the seller to see if there was a problem. He complained that paypal required a fee of $1.75 and that he wanted me to send him a money order to cover it. I told him this was to his account and even copied the ebay “sellers rules” that clearly state this, but he continued to demand payment stating “I will not take a pay cut” and getting very abusive.
I contacted e-bay and made a complaint and the next day he begrudgingly told me “Go ahead and send the money again, I will take the pay cut”
I should have had the sense to walk away from this guy, but I didn’t!!!!

I had sent my full mailing address via paypal and by separate e-mail and yet FedEx said they could not deliver and after much screwing around I eventually received the modem and noted that the seller had miss addressed the package.
On opening the package, I found that he had not sent the power supply so I contacted him again. He confirmed that he had forgotten to send it and would try and find it and send it to me. After three days he eventually came back and said he was not sure which was the correct power supply and therefore would I send the modem back, at my cost. I had had enough of this and told him that I would buy another power supply from Radio Shack, but that I was not happy with the whole transaction.

I left him the following Negative Feedback “Absolute disaster, problems with paypal, missing parts and shipping”. He immediately retaliates with Negative Feedback saying “This guy doesn’t pay for winning an auction and he doesn’t pay for shipping”.

I have tried to reason with this guy, but he has turned completely abusive, calling me a Con Man, Liar and Dumb Loser.

I don’t want my money back, or payment for the power supply, I was prepared to leave him negative feedback, put it down to experience (there are always a few bad apples) and move on. But his Negative Feedback, which is pure retaliation and his abusive e-mails have made me want to fight this person.

To make matter worse I don’t seem to be able to access ebays help forums and complaint line.

I have kept all correspondences for this transaction and have scanned them into a pdf file.

1. Is there anything I can do with this guy and my negative feedback?
2. Should I send the dossier of correspondences to e-bay?

Any advice would be greatly appreciated

Regards,

I'm not sure if you can respond to his negative response but I would try to pursue it with ebay as far as they will accept.
Try this link to get thru to ebay email.
follow the steps. it should take you to email link. good luck. Ebay is a wonderful vehicle. don't let one bad experience turn you off.

http://pages.ebay.com/help/contact_inline/index.html

Respond to the negative feedback.
Just something simple.

What kind of modem was it?.. did you get the power supply yet?... if it's a us robotics/3com external, I have some I could send you, if you can't find the right one at radio shack, or at least let you know what you need.

LC, Respond to his Neg. feedback, honestly without insulting the guy. I would put something like, "I paid via pay pal right after close, Not my fault that you have to upgrade and pay small fee to accept Paypal credit card payments."

FYI to accept Paypay credit card payments you have to upgrade from the free account. I don't mind, Paypal is great for buyers and sellers.

That reminds me I have some $$$ in the paypal account time to do some ebay shopping.

almost 200 ebay transactions myself and same
happened to me. guy didn't ship my item for
almost 6 weeks after he got paid so I left
him a negative feedback. he immediately left
one for me saying i was unreasonable.
you get the last word though! I was able to
leave a response to his negative. said something
like; "if wanting something I paid for in less
than 6 weeks is being unreasonable, I guess I am."

Re: Another ebay problem

Thanks for the offer of the power supply ndemge, I did get one from Radio Shack and of course it was the most expensive at $25.00. I’m sure I could have bought a new Speed Touch Home for the $75.00 that this has now cost me!

I am disappointed to see that some ebayers will not leave negative feedback after a bad experience, as they are concerned about retaliation. Seems to go against the whole idea about the feedback system and shows there are probably a lot of ebayers out there that have perfect feedback, but should not.

I did respond to his negative feed back “Total retaliation, e-mail me for details” and he then responded with “Beware this guy is a con artist and like to threaten peoples, email me …Beware”.

We could go back and forth but really what’s the point, if ebay won’t do anything about it I will keep my dossier on this transaction and the next time I bid on something, I’ll send a copy to the seller to show him that I kept my side of the deal.

Re: Another ebay problem

I have over over 350 transactions (probably almost twice that many because it seems only half the people leave feedback) and the way I handle it when I have to leave negative feedback is give it to them on the last day possible so they won't drop a negative on me for retaliation.
You have 90 days to leave feedback and I try and give it to them on day 89 late at night.
There's a raghead in New Jersey thats getting negative feedback here in a few days for selling me a piece of junk computer tower.
It works because I don't have any negatives yet.

It is too bad that there are those kind of people out there, as Ebay is really a kick to play on!! I put things on there sometimes just to see what I can get out of them! I was helping the guy I work for clean out his shop when I went to work here and found an old set of spark plug wires for a Boss 429 Mustang that he had sold a couple of years back! They were original but had the bakelite ends on them and they were all cracked! The wires were good and had the correct #s on them! I almost threw them in the garbage, but decided to put them on Ebay just to see what would happen! Would you beleive I got $175.00 for them?? :D :D

LubeDude

Re: Another ebay problem

I have two neg feedbacks. 1)I sold the guy a guitar that had the pick-ups changed (stated in the auction.) After he had the guitar for over a week he said he wanted $200 back, I told him to send the guitar back and I would refund all $900 and he said no,I wouldn't send him the $200 so he left me neg, feed back. 2) I won a silverado cd player, when I received it , it was for an S-10.I sent it back and then he told me he sold mine to someone else and would not pay for my return shipping.I lost $15 and got nothing so when he started getting nasty with me I left neg feed back, so he left me neg feedback.just respond to to the feedback and leave it at that.

Lost Canadian, eh? Sorry, my joke. When you leave feedback don't be vague. Say specifically what happened and leave it at that. Other readers will see and understand it. To say 'absolute disaster' is open to interpretation and does not add clarity for future readers, only opens you to same vague feedback..good luck and smooth sailing.

Re: Another ebay problem

YES YOU CAN do something about negative feedback and get it removed!

You need to contact SquareTrade and get a mediator. They can remove feedback, but there is a $20 fee for hiring a mediator.

Square Trade on-line dispute resolution

I had to use this place once, and I had the feedback removed.

As far as your money back, contact PayPal and have their hounds go after the guy.

Keep all correspondence like you are doing. PayPal and Square Trade will need it.

Good Luck,

H.

Re: Another ebay problem

One ebayer shipped me wrong item, took almost 2 months for my money to be returned. I filed a complaint with my state, his state, and the FCC, and threat with me comming to his state and filing small claims court. He returned full amount including shipping and return shipping, still thinks my fault because he shipped wrong item. Ebay is ok if you know who you are dealing with. I now have a list for marine stuff.

Re: Another ebay problem

No joy with SquareTrade! :(
I went through the process but to no avail. The mediator was even getting frustrated with this clown as he refused to acknowledge any wrong doing and kept changing his story even though I supplied all the documentation to prove he was lying. The problem with the SquareTrade and the mediation process is that the mediator cannot make a final decision, even if he has the hard evidence to show that one party is not telling the truth, so he tries to get a compromise, which in my case was to remove both parties negative feedback. I feel this makes a mockery of the whole ebay feedback; we then have people with perfect feedback history that are far from perfect!

I made the decision to live with the retaliatory negative feedback he left me and plan on sending a copy of all our correspondences that clearly show he was the guilty party to any ebayer that I do business with in the future. I will also send this same document to any one who deals with him too, let them decide if they want to continue with the transaction.

Final kick in the crutch!
I paid $40.00 plus $10.00 shipping for the modem, another $25.00 for the replacement power supply and $20.00 to SquareTrade. So I spent $95.00, received negative feedback and still don’t have the thing working

Re: Another ebay problem

I'm a powerseller with a FB of over 2500 now. Truth is, even as a PS, feedback is very hard to get removed. It does happen but very rarely. Usually only if it violates eBay guidlines - names a person's name, vulger, w/in 24 hrs of auction closed, states results of investigation, etc.

For buyers, feedback doesn't mean a thing. Sellers rarely check buyers feedback and cancel a bid unless the feedback in in the neg range and you see it when you check your auctions. Some people will ask you not to bid unless you have some + number but they are rare.

Feedback is much more important for Sellers when they have a low feedback number becuase Buyers do check it and a risk premium gets built in to the highest bid you are going to get. For example, I can buy stuff from non-PS Sellers and sell it for a profit becuase my rsik premium is near zero.

Ryan had the best advice. Just respond "Retaliatory feedback" and that's all you need to do - anybody who want to check can easily see you are telling the truth. Otherwise, don't sweat it.
