actually the wording comes across not as a warning for the battery, rather a warning to the regulator
No where do they say anything about damage to the regulator....pretty obvious the battery specific language is there to address consequential damage claims.

I run 2- flooded deep cells on my boat. One dates to 2009 the other 2010. Their predecessors where 7 and 8 years of age.

Nothing special..ACR onboard..average 300-350 hours of run time past 4 years. 450-500 hours a year before that.

Well for my regulator, they explicitly state to not use Maintenance-free, AGM or Dry Cell batteries as it void warranty...their wording doesn't sound like they care about the battery.

what they sent me

and somewhere else they discuss the various batteries and why to use only non-maintenance-free batteries, like you have.

not sure what ACR means, but PLEASE do tell me your battery brand and size as you seem to have good luck with them.

I can only fit group 24 in the area..the optimas being compact fit nicely...I looked and have the following models
SC34DM (this seems to be a starting one...blue top/black body)
and
D34m (this seems to be dual purpose...bue top/grey body)

now I am debating just running the AGMs with the current regulator, then switch the batteries when the current reg fully dies, then install my new one to be warranty compliant...

but do tell me your brand batteries none the less, as I might bring my self to be compliant early.

I just ran into the same thing with CDI. From what I read from my manual it says that the unregulated rectifiers (5amp) need flooded or none sealed batteries however on the 12amp rectifier unit it is a regulated unit and hence sealed or maintenance battery is ok.
ive emailed CDI to confirm as they may have simply cut/paste these comments from the 5amp unit to the 12amp instruction sheet

Opps missed this key picture on the regulated 12amp unit
