Article 128 of the Uniform Code of Military Justice describes assault in these terms: "Any person subject to this chapter who attempts or offers with unlawful force or violence to do bodily harm to another person, whether or not the attempt or offer is consummated, is guilty of assault and shall be punished as a court-martial may direct."

What libral passifist wrote this! Whoever they are, I can gaurentee that that person never wore a military uniform, just that geek suit all them lawyers wear! The Geneva Convention Treaty is a farce, and has never been followed. If it had been, we would still be fighting WWII !! This war is a fight against a CULT RELIGION, that can never be won following a rule book! The enemy is not following the rules, knowing that they can only win by being decitful, backstabbing prickks that they truely are! (Not unlike many Americans have become!) (But none of them visit this site though, thank God!) The only way to win this war, is with ingenuity, resorcefullnes, tactics, and BRAVERY, not by following a book of rules written by people who have never been in combat!

The Uniform Code of Military Justice (UCMJ) is the bedrock of military law. The UCMJ is a federal law, enacted by Congress. Articles 77 through 134 of the UCMJ are known as the "punitive articles," -- that is, specific offenses which, if violated, can result in punishment by court-martial. The law requires the Commander-in-Chief (The President of the United States) to implement the provisions of the UCMJ. The President does this via an executive order known as the "Manual for Court Martial" (MCM). Chapter 4 of the MCM includes, and expands on the punitive articles. The MCM divides the punitive articles into six parts: The text, elements of the offense, an explanation, lesser included offenses, maximum permissible punishments, and sample specifications. In the United States, Articles of War were adopted by Congress for the governance of the Continental army during the American Revolution. Under the present constitution, Congress enacted "Articles of War" with respect to the army, "Articles for the Government of the Navy," and "Articles for the Discipline of the Coast Guard." In 1951 these were replaced by the Uniform Code of Military Justice for all the services.

WVIT: Your "lawylery" point of view really doesn't work in the absolute lack of adherence to the subject laws. This enemy is not an enemy combatant as defined by the Geneva Conventions. They wear no uniform, do not adhere to recognized laws, and do not belong to a recognized state. They are radical islamists who hate us, kill by any means, and do not respect the difference between combatants and non-combatants. The Geneva convention is relieved as a valid point due to their actions. The UCMJ and the Geneva convention writings are both very clear about the above. Go chase another ambulance, lawyer.

Glad to see I'm not alone. First off rodbolt- Learn how to write a little better. We all make mistakes, what you are doing is a disgrace to our laungauge. Second- Since when did you fight a fight fair? As a child my dad wouldn't beleive me whenever I told him 3 guys kept beating me up every day. One day he came home right before I got off the bus. Yep, the ole boys roughed me up again. He taught me a thing or two and outfitted me with a few "accersories" to help even the odds. I said it wasn't fair to hit people with a piece of pipe. He asked me what was fair with 3 on 1? That next day I did a little a$$ kicking myself. They wouldn't give the respect so I TOOK it. I have since learned that you don't fight to be fair, you fight to WIN. I will gladly bite your "urine eliminator tool" if I am in a position to do so. There is no shame here, its all about winning and doing it as soon as possible. Go USA!!!!!!!!!!!!!!!!!!!!!!!!!

occurs to me the real problems we are currently having in Iraq are partly due to a change of roles. we have the best fighting men and women in the world IMO, but fighting an peacekeeping are much different. changes the playing field considerably! completely confident of our ability to adapt, but there's gonna be some glitches. we will overcome

Good point MY. I was listening to some dude on Imus yesterday morning. He basically said the same thing, we are really good at killing people and destroying things. However, unlike the British, we are not so hot at providing a colonizing police force. So IMO I say let's do what we are really good at!!!!

Once power has been transferred back to the Iraqi government, which I'm sure we all hope will be sooner than later, after which hopefully you don't think your above statement will still hold true. If your statement is correct, (and it isn't fortunately) we've got big problems because theres not much difference between Iraq and any other Muslim nation except for what was Sadam and his hierarchy. Also, CastawayRay, adding racism to the mix won't help a bit. "Ragheaded scum"? Wheres the moderator?? Did any of the hijackers have turbans? Does Saddam wear one? Lots of Americans do! That was a rude and uncalled for remark.

The only mistake Col. West did was to advise his superior's of his action, using his 9mm as he did. I have seen these voluntary statements bite the butt of the good guys too many times. If he would have kept his mouth shut, I don't think he would be in the uncomfortable position he is in today. When in doubt, KEEP YOUR MOUTH SHUT, you can explain your actions later, if need be, especially after positive results occur, which is what happened. This no different that you getting pulled over by the police and have the officer ask, "do you know how fast you were going." "Yes, I was going 85 mph." WRONG ANSWER, BUCKO You just cooked yourself voluntarily. Get the point?

According to the TV news here last night the US forces have lost the same amount dead thus far in Iraq that they lost in the entire first year of war against Vietnam. I personally think a statement like that, taken along with the things the soldier mentioned in the first post has seen, suggests you're in for the long haul. If an indiscretion gets dividends like that then the ends justify the means. No don't get me wrong I'm not giving cart blance to the forces to tourture everybody, but if that man had excellent reason to believe the prisoner held the information gained then I'd happily make an exemption for him. However he'd better prove the worth of the info afterward. You don't get to his rank by being a fool, and I suspect he had knowledge specific to what he was looking for. I suggest he was acting with very strong suspicions (which appear to have been proven right). Ross

Some food for thought. In the early seventies in Syria there was a large concentration of moslim fundamentalists in the city of Homs. The Syrian government decided to put an end to the fundamentalist threat.They surrounded the city with troops and artillery,then started a prolonged bombardment in which over twentyfive thousand of their own compatriots were killed. Afterwards the city of Homs(what was left of it)was the place where the Syrians liked to take people so they could see what might happen to them if they disagreed with their President(Assad). This is the sort of people our soldiers are dealing with.Do you want our people to go down to that level???? Or would you rather get the hell out of there and spend 87 billion on research for alternative fuel and once you have found it let the -rabs drown in their by then useless oil? Remember, Irak was not connected to El-Kaida.Irak was never a nation as we understand this term.It is a group of tribes that became a nation because one group suppressed al the others and made them subservient.In my eyes this entire "nation building adventure is completely foreign to these people.Their allegiance is to their valley and their village with their local warlord. In my opinion not even one of our soldiers should die for big oil and its cronies. I have lived in the middle east for 28 years and fought in several of its wars.(on the winning side).

I saw the same footage on TV (there weren't thousands dancing, but there were some thats to be sure). I was infuriated. But I am intelligent. I understand more on this subject than the headlines, and what YOU read in the news. Do you think it represents their entire populous or a potion of? Just like there is a racist population in the US (you being one of them) it doesn't mean all Americans are racists. I still don't know what you mean by "raghead" I guess. Many religions and ethnic backgrounds wear some sort of traditional garment on their head. This post was about excessive force in the military, and you used it to vent your hatred towards what you refer to as "ragheads". I guess you bought that red truck of yours to match your neck.

Ross J, Actually, Its worse, there have been more US military casualties so far in this war than in the first 3 years of the Vietnam war. Getting back to the original topic, I guess if the tactic worked, the only harm done was that an Iraqi soldier $hit his pants.
